The Oglala Sioux Tribe is seeking proposals from qualified Design Builders to provide design and construction services for three (3) government service buildings in the Oglala District, Pine Ridge District, and Wakpamni District on the Pine Ridge Indian Reservation. The Oglala Sioux Tribe is a federally-recognized Indian Tribe located on the Pine Ridge Indian Reservation in South Dakota. In response to the COVID-19 public health emergency, the Tribe has allocated $4.5 million for the Project Management, Design, Construction and taxes and fees of each Multipurpose Government Service Building. These buildings are necessary to enable the Tribe and its Districts to provide essential programs and services to tribal members to respond to and mitigate the COVID-19 public health emergency and its negative economic impacts on the Reservation. The buildings will be owned by the Tribe. All costs must be incurred by December 31, 2024 and all payment under the contract must be made by December 31, 2026 This Request for Proposals (RFP) is a solicitation of bids only and neither the issuance of this RFP nor the submission of a responsive proposal shall be binding to the Tribe. The Tribe reserves the right to accept or reject any or all proposals or to cancel this RFP for any reason or no reason. No binding agreement shall exist with respect to the provision of services unless and until an agreement has been agreed and executed by both the Tribe and the selected service provider. The Tribe will not be liable under any circumstances for any expenses incurred by any bidder in connection with the RFP proposal submission or selection process. The Tribe reserves the right to select one or more Design Builders based on the best interests of the Tribe and to make a contract award to the firm(s) whose proposal is (are) the most advantageous to the Tribe, with price and other factors, including qualifications, experience and capacity to perform the services, considered. General contract provisions include choice of law, choice of forum for dispute resolution, and a clause addressing tribal sovereign immunity. Please be advised that the Oglala Sioux Tribe routinely includes provisions stating that contracts are governed by the laws of the Oglala Sioux Tribe, disputes are to be resolved in the courts of the Oglala Sioux Tribe, and the sovereign immunity of the Oglala Sioux Tribe is preserved. Contractors are expected to comply with all applicable tribal and federal laws. Standard Form of Agreement A141-2014 is the anticipated contract format. Each respondent must submit two (2) printed copies and one (1) electronic copy in the form of an UBS or CD for each Tribal District Building. It will be the responsibility of the proposing individual or firm to insure the proposals are delivered to the address below. The envelope must be sealed, clearly labeled with the Tribal District Name "_____________ District Government Service Building" and must also be clearly labeled "DO NOT OPEN." No late, electronic, emailed, or faxed proposals will be accepted. The Oglala Sioux Tribe reserves the right to refuse or reject any and all submissions. The selected individual(s) or firm(s) must agree to abide by the laws and jurisdiction of the Oglala Sioux Tribe.
