Description: The City of Westfield on behalf of the Westfield-Barnes Regional Airport, Massachusetts invites sealed bids for furnishing all labor and materials and performing all work in connection with a construction contract at the Westfield-Barnes Regional Airport, Westfield, Massachusetts as follows: RELOCATE, CONSTRUCT, AND REPAIR TAXIWAY B SOUTH The project consists of the relocation and reconstruct of Taxiway B South (approximately 14,000 SY) including taxiway edge lights, taxiway signage, pavement marking, Runway 02 REILs and drainage improvements. Also included is a reconstruction of a portion of Taxiways B1, B2, and B4. The work to be completed under this contract includes furnishing all labor, equipment, materials, tools, and incidentals necessary to complete all work in accordance with the provisions of the Contract; the Contract Plans, the Contract Specifications, Contract Addenda, Environmental Permits and all incidentals as may be directed by the Engineer. All materials to construct and to be installed on this project shall be new and are subject to the "Buy American Clause". Procedures regarding bids and the selection of contractors shall be in conformity with the Massachusetts General Laws, Chapter 30, Section 39M, as amended to date. General Bids must be submitted on the Form for General bid included herein. The General Bids shall be filed with the Owner at the location designated above, accompanied by a bid deposit in the form of a bid bond or a certified check, in the amount not less than five percent (5%) of the bid price for the Contract work. The bid security shall be made payable to the City of Westfield. Qualifications: The proposed improvements to be accomplished under this contract will be subject to the Commonwealth of Massachusetts EEO, Anti-Discrimination and Affirmative Action Program goal for this work. A one and a half percent (1.50%) goal for employment of M/WBE firms certified by the Massachusetts Unified Certification Program (UCP) has been established for this project. Attention is called to Massachusetts Labor Standard provisions regarding conditions of employment, including requirements that minimum wage rates be paid to contractor employees in accordance with M.G.L. Chapter 149, Sections 26 to 27D and the Federal Wage Rates, whichever is higher. The Contractor must comply with the Federal Civil Rights Act of 1964, Title VI; Airport and Airways Improvement Act of 1982 General Civil Rights, Section 520; Disadvantage Business Enterprise Title 49 CFR Part 26; Lobbing and Influencing Federal Employees, Title 49 CFR Part 20; the Occupational Safety and Health Act; the Contract Work Hours and Safety Standard Act; and Executive Order 11246. The successful contractor will be required to submit a certified payroll on a weekly basis for review by the designee of the awarding authority. The Contractor must comply with the Buy American Preference (49 USC 50101); Civil Rights - Title VI Assurances (49 USC 47123; FAA Order 1400.11); Davis-Bacon Act (Title 29 CFR Part 5; 2 CFR 200, Appendix D); Government-wide Debarment and Suspension (2 CFR Part 180, Subpart C; 2 CFR Part 1200; DOT Order 42005); Disadvantaged Business Enterprise (49 CFR part 26); Foreign Trade Restriction (49 USC 50104, 49 CFR Part 30);Lobbying And Influencing Federal Employees (31 USC 1352 - Byrd Anti-Lobbying Amendment; 2 CFR part 200, Appendix II(J); 49 CFR part 20, Appendix A); Procurement Of Recovered Materials (2 CFR 200.322; 40 CFR part 247; Solid Waste Disposal Act). Special Requirements: Title VI Solicitation Notice The Westfield Airport Commission, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. 2000d to 2000d-4) and the Regulations, hereby notifies all bidders or offerors that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity 1. The Offeror's or Bidder's attention is called to the "Equal Opportunity Clause" and the "Standard Federal Equal Employment Opportunity Construction Contract Specifications" set forth herein. 2. The goals and timetables for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows: Timetables Goals for minority participation for each trade: 4.8% Goals for female participation in each trade: 6.9% These goals are applicable to all of the Contractor's construction work (whether or not it is Federal or federally assisted) performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, it shall apply the goals established for such geographical area where the work is actually performed. With regard to this second area, the Contractor also is subject to the goals for both its federally involved and non-federally involved construction. The Contractor's compliance with the Executive Order and the regulations in 41 CFR Part 60-4 shall be based on its implementation of the Equal Opportunity Clause, specific affirmative action obligations required by the specifications set forth in 41 CFR 60-4.3(a) and its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade, and the Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor or from project to project for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, the Executive Order and the regulations in 41 CFR Part 60-4. Compliance with the goals will be measured against the total work hours performed. 3. The Contractor shall provide written notification to the Director of the Office of Federal Contract Compliance Programs (OFCCP) within 10 working days of award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the name, address, and telephone number of the subcontractor; employer identification number of the subcontractor; estimated dollar amount of the subcontract; estimated starting and completion dates of the subcontract; and the geographical area in which the subcontract is to be performed. 4. As used in this notice and in the contract resulting from this solicitation, the "covered area" is Massachusetts, Hampden, Westfield. Disadvantage Business Enterprise Bid Information submitted as a matter of responsibility: The Owner's award of this contract is conditioned upon Bidder or Offeror satisfying the good faith effort requirements of 49 CFR 26.53. As a condition of responsibility, every Bidder or Offeror must submit the following information on the forms provided herein within five days after bid opening. 1) The names and addresses of Disadvantaged Business Enterprise (DBE) firms that will participate in the contract; 2) A description of the work that each DBE firm will perform; 3) The dollar amount of the participation of each DBE firm listed under (1); 4) Written statement from Bidder or Offeror that attests their commitment to use the DBE firm(s) listed under (1) to meet the Owner's project goal; 5) Written confirmation from each listed DBE firm that it is participating in the contract in the kind and amount of work provided in the prime contractor's commitment; and If Bidder or Offeror cannot meet the advertised project DBE goal, evidence of good faith efforts undertaken by the Bidder or Offeror as described in appendix A to 49 CFR part 26. The documentation of good faith efforts must include copies of each DBE and non-DBE subcontractor quote submitted to the bidder when a non-DBE subcontractor was selected over a DBE for work on the contract. This Bidder or Offeror must submit the DBE's written confirmation of participation within 5 days after bid opening. It is the policy of the City of Westfield to practice nondiscrimination based on race, color, sex or national origin in the award or performance of this contract. The Owner encourages participation by all firms qualifying under this solicitation regardless of business size or ownership. General Bidders and all other levels of contractors on this work will be required to sign, in accordance with the M.G.L. 62C Sections 47A through Sections 49A, a Certificate of Compliance with the Tax Laws of the Commonwealth of Massachusetts. The Commonwealth of Massachusetts requires all out of state vendors soliciting business in the State to be registered as a Foreign Corporation in the Commonwealth of Massachusetts. Out of State businesses must file a foreign corporation form appointing an agent for services and processing within the State of Massachusetts. The form may be obtained from the state portal for completion. Proof of registration as a foreign corporation must be submitted with the bid. The Bidder must supply all the information required by the proposal forms and specifications and must bid on all items, including the Statement of Qualifications package. The Owner reserves the right to waive any informality or to reject any or all bids, or to accept any other bid than the lowest bidder should it be deemed to be in the best interest of the Airport Commission to do so. No bid may be withdrawn for a period of one hundred and twenty (120) calendar days following the actual date of the bid opening and the bidder must hold bid prices for this period. The Owner reserves the right to waive any informality in or to reject any or all Bids if deemed to be in their best interest.
