Notice is hereby given by order of the Marin County Board of Supervisors, that the Director of Public Works will receive bids for:Civic Center Campus Roads and the Pit Parking Lot Slurry Seal Project This project includes Type I Slurry over Type II Slurry on the Pit Parking Lot, Type II Slurry on Peter Behr Drive, Judge Hailey Drive and Vera Schultz Drive, and pavement striping and marking on the Civic Center Campus Note: For public convenience, the roads and the parking lot cannot be completed on consecutive days or the same day (unless it is a holiday Monday). Bids are required for the entire work described herein. The Contractor shall possess a valid Class A License at time of bid submittal. To bid on this Project, the Bidder and all subcontractors are required to be registered as a public works contractor with the Department of Industrial Relations pursuant to the Labor Code. The Bidders and all subcontractors registration must remain active throughout the term of the Contract. A Bid Bond, cash, certified check, or cashiers check, in the amount of 10% of the total bid amount payable to the County of Marin shall accompany the Proposal. Award of contract, if awarded, will be to the lowest responsible bidder whose proposal complies with prescribed requirements, and will be within thirty (30) days after receipt of proposals. The Board of Supervisors of the County of Marin reserves the right to reject any or all bids and the right to waive any irregularities. At the successful Contractors option, securities may be substituted for the required retention, in accordance with the provisions of Section 22300 of the State of California Public Contract Code. Pursuant to Public Contract Code Sections 7201 and 9203, the County of Marin shall retain 5 percent of the contract price until final completion and acceptance of the project. This project is to be advertised pursuant to Public Contract Code 22036. There is no pre-bid meeting scheduled for this project. Questions concerning the Bid should be submitted via Bid Express no later than 5 p.m. on Thursday, April 27, 2023. Inquiries or questions based on alleged patent ambiguity of the plans, specifications or estimate must be communicated as a bidder inquiry prior to bid opening. Bidder shall thoroughly investigate the conditions which will be encountered in the project including, but not limited to, existing underground and overhead utilities, steep roads, narrow contract and access roads , road width, space needed to flag traffic, tree coverage and other shade, local fog conditions, staging and site access challenges. This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990. The County of Marin hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged business and woman owned business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color or national origin in consideration for an award. This is a public works contract subject to the provisions of Part 7 of Division 2 of the California Labor Code (Sections 1720 et seq.). In accordance with Labor Code Section 1771, Contractor and all subcontractors shall pay not less than current prevailing wage rates as determined by the California Department of Industrial Relations (DIR) to all workers employed on this project. Pursuant to Section 1773 of the California Labor Code, the general prevailing wage rates for Marin County where the work is to be done have been determined by DIR. These wages are set forth in the General Prevailing Wage Rates for this project, available at the Department of Public Works. In accordance with Labor Code Section 1815, Contractor and all subcontractors shall pay all workers employed on this project 1 1/2 the basic rate of pay for work performed in excess of specified hour limitations. The work performed pursuant to this agreement is subject to compliance monitoring and enforcement by the Department of Industrial Relations. California Labor Code Sections 1777.1, 1775, and 1813, describe potential penalties contractors or subcontractors may be subject to for failure to comply with the prevailing wage law. Equipment rental rates as determined by the State of California are listed in the Department of Transportation publication entitled Labor Surcharges and Equipment Rental Rates, issued semimonthly. The U.S. Department of Transportation (DOT) provides a toll-free hotline service to report bid rigging activities. Bid rigging activities can be reported Mondays through Fridays, between 8:00 A.M. and 5:00 P.M., eastern time, Telephone No. 1-800-424-9071. Anyone with knowledge of possible bid, bidder collusion, or other fraudulent activities should use the hotline to report these activities. The hotline is part of the DOTs continuing effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. All information will be treated confidentially, and caller anonymity will be respected.
