Per the owner, as of January 4, 2024, construction has started on this project and is anticipated to be completed in April 2024. ................ Before submitting bids, Contractors shall be licensed in accordance with the Laws of the State of California. Accordingly, the successful Bidder shall possess a Class A, General Engineering, Contractor's License at the time this contract is awarded. Before submitting bids, Contractors shall be licensed in accordance with the Laws of the State of California. Accordingly, the successful Bidder shall possess a Class A, General Engineering, Contractor's License at the time this contract is awarded. A certified check, cashier's check, or Bidder's Bond executed by an admitted surety insurer in the amount of ten percent (10%) of the bid, and properly made payable to the City of Pismo Beach, will be required to accompany each proposal. The successful contractor will be required to furnish [three (3)] acceptable surety bonds: one for faithful performance, one for labor and materials [and the other for maintenance following construction]. Each bond is to be executed in a sum equal to one hundred percent (100%) of the contract price [except that the maintenance bond shall be for ten percent (10%) of the contract price and shall remain in effect for one year following acceptance of the project for final payment]. The successful contractor will be required to obtain a business license from the City and pay related fees. Provision is made for security substitution on payment withholds as provided in Public Contract Code Section 22300. It shall be mandatory upon all contractors and subcontractors listed on all bid proposals be registered with the Department of Industrial Relations (DIR) pursuant to Labor Code section 1725.5, unless exempt per Labor Code section 1771.1(a). It shall be mandatory upon the contractor to whom the contract is awarded, and upon any subcontractor under the contractor, to be registered with the DIR pursuant to Labor Code section 1725.5, and to determine the rate and to pay not less than the State Prevailing Wage and per diem rate to all laborers, workers and mechanics employed by them in the execution of the contract. The contractor will be required to maintain and distribute certified payroll records in compliance with Section 1776 of the California Labor Code. Prevailing Wage Rates are on file in the office of the City Clerk of the City of Pismo Beach. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. In submitting a bid to a public purchasing body, the bidder offers and agrees that if the bid is accepted, it will assign to the purchasing body all rights, title, and interest in and to all causes of action it may have under Section 4 of the Clayton Act (15 U.S.C. Sec. 15) or under the Cartwright Act (Chapter 2 (commencing with Section 16700) of Part 2 of Division 7 of the Business and Professions Code), arising from purchases of goods, materials, or services by the bidder for sale to the purchasing body pursuant to the bid. Such assignment shall be made and become effective at the time the purchasing body tenders final payment to the bidders. Contract award will be based on the base bid plus bid alternates 1-3. The right is reserved by the City of Pismo Beach to reject any or all bids, to evaluate the bids submitted, and award the contract to the lowest responsive bidder. The City further reserves the right to waive any informalities or minor irregularities in the bid. No bidder may withdraw their bid for a period of sixty (60) working days after the date set for the opening thereof.
