NOTICE OF INTENT TO SOLE SOURCE THIS ANNOUNCEMENT IS FOR INFORMATION PURPOSES ONLY The U.S. Army Corps of Engineer (Memphis District) hereby gives notice of their intends to negotiate a modification for contract number W912EQ21D0002 with Great Lakes Dredge & Dock Company 9822 Katy FWY STE 1200, Houston TX 77024-1273 (Cage Code: 1BSU5) on a sole source basis in accordance with Federal Acquisition Regulation (FAR) Subpart 6-302-2(a)(2). The project consists of making or enlarging dredge cuts, construction of fills, construction of new harbor channels and dredging in various channels and harbors. The Contractor shall deliver the dredge and attendant plant ready for operation in the vicinity of McKellar Lake Harbor, Memphis, TN (Mile 725 AHP), or to any other work site as may be directed. The dredge shall be not less than 24-inch nominal diameter discharge and have a manufacturers horsepower rating for continuous operation of not less than 3,200 brake horsepower. Dredges larger than 29-inch will be considered, however, the estimated output will be based on the quantity shown for a 29- inch dredge. The supplies or services to be procured in this solicitation are classified under NAICS 237990. The statutory authority permitting Other than Full and Open Competition is 10 U.S.C. 3204(a)(2), as implemented by Federal Acquisition Regulation (FAR) 6.302-2(a)(2), Unusual and Compelling Urgency, when the agency's need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for. This notice of intent is not a request for proposals, quotations, or solicitation. A solicitation will not be issued for this requirement. Nonetheless, responsible sources may submit a capability statement, which, if received within ten (10) calendar days after the date of the publication of this notice of intent to award a sole source procurement, will be considered. Any responses or inquiries to this notice must demonstrate clear and convincing evidence that competition of this action will be advantageous to the Government. The Government will not reimburse respondents for any costs incurred in preparation of response to this announcement. A determination by the Government not to compete this procurement action, based on responses to this notice, is solely within the discretion of the Government.
