The work to be done, in general, consists of tree pruning services with a small allowance for tree removal and emergency call out work. As the Citys annual tree maintenance contract, the project duration is one year, with the possibility of being extended an additional year. The bid will be awarded to the lowest responsible bidder at the discretion of the City Council. The City reserves the right to reject any and all bids, or to waive any errors, discrepancies or irregularities. A prebid meeting has not been scheduled, nor is one anticipated for this project. Bids must be accompanied by a proposal guarantee amounting to ten (10%) percent of the total bid as described in the specifications. In accordance with California Civil Code Section 3248, the payment or labor and materials bond must be in the amount of one hundred percent (100%) of the total amount payable by the terms of the project contract and the bond must guarantee payment to persons listed in California Civil Code Section 3181 and payment of any amount due under or subject to the Unemployment Insurance Code. The performance bond must be in the amount of one hundred percent (100%) of the amount payable by the terms of the project contract to guarantee the faithful performance of the project work. The warranty or maintenance bond must be in the amount of ten percent (10%) of the final Agreement amount and guarantee the project work against defects in materials, equipment, workmanship, or needed repairs for one (1) year from the Citys acceptance of the project work. The Contractor shall possess a Class D-49 California contractors license at the time this contract is awarded. Bids are required for the entire work described herein. This contract is subject to the State contract nondiscrimination and compliance requirements pursuant to Government Code Section 12990. Minimum wage rates for this project as predetermined by the Secretary of Labor are set forth in the special provisions. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and prevailing wage rates determined by the Department of Industrial Relations for similar classifications of labor, the contractor and his subcontractors shall pay not less than the higher wage rates. Pursuant to Section 1773 of the Labor Code, the general prevailing rate of wages in the county in which the work is to be done has been determined by the Director of the wage rates appear in the Department of Transportation publication entitled General Prevailing Wage Rates, (current semi-annual which have been predetermined and are on file with the Department of Industrial Relations are referenced but not printed in said publication.
