Building and Facility Construction and Maintenance Services If the sum of the Base Bid and all Alternate Bids is $100,000.00 or greater, the Bid shall be accompanied by a bid security in the form of a certified check in the amount of five (5) percent of the sum of the Base Bid and all Alternate Bids payable to Anne Arundel County Public Schools or surety bond in the amount of five (5) percent of the sum of the Base Bid and all Alternate Bids, pledging that the Bidder shall enter into a Contract with the Owner on the terms stated in the Bid and will furnish bonds covering the faithful performance of the Contract and payment of all obligations arising thereunder. Should the Bidder refuse to enter into such Contract or fail to furnish such bonds, the amount of the bid security shall be forfeited to the Owner as Liquidated Damages, not as a penalty Bidders should note the requirements for Bid Security and Payment and Performance Bonds contained in the instructions to Bidders as modified by AACPS. Bids submitted without required bid security documents shall be rejected as not responsive. The amount of Payment and Performance bonds shall be determined by the ultimate award amount. It is the intent of AACPS to actively participate in the achievement of the MBE participation requirement contained herein. The contractor or suppliers who provide materials, supplies, equipment, and/or services for this project shall attempt to achieve a minimum percent 15 of the total dollar value, with a minimum of 0 percent from certified African American-owned businesses, a 0 percent from certified Women-owned businesses, and the balance from all certified minority business is directly or indirectly, from Maryland Department of Transportation certified Minority Business Enterprises and the balance from all certified minority business enterprises. Where scanning equipment is located, their identification will be scanned to ensure compliance with paragraph Child Sex Offender Notification of this section. If the Contractor's representative cannot produce this required documentation, or the scan identifies the employee(s) as a registered offender, the school reserves the unilateral right to not allow Contractor's employee(s) on site for any reason.
