The Montana Department of Environmental Quality is soliciting competitive sealed bids under a Limited Solicitation for abandoned mine reclamation work in Sheridan and Roosevelt Counties, Montana. As a Limited Solicitation, any bid exceeding $100,000 will not be considered. Question Submission Close Date:10/27/2023 3:00 PM MDT Bids will be received for one General Contract, for all work sites. The purpose of this reclamation project is to limit human and livestock exposure to the physical hazards that exist at the sites which are primarily subsidence features. This reclamation project includes, topsoil stripping and stockpiling, exposure and stabilization of subsidence features, embankment (i.e. development of a borrow area), placement of conserved topsoil, revegetation of disturbed areas, and fencing in certain situations. Temporary Erosion and Sediment Control (TESC) will be required to complete the reclamation of the sites. Straw wattles will be installed in the drainage paths leading to discharge points and mulch will cover distrubed areas to help stabilize the surface material where applicable. Contractor must clear and grub work areas; install temporary and permanent erosion control measures as shown or as necessary to control the work area. Contractor must remove all debris deemed hazardous or not salvageable, from site. Once subsidence feature mitigation has been performed, the conserved topsoil will be placed over the area and revegetated as soon as possible, within the seeding window. Where required, fencing will be installed either before revegetation or after, as access needs dictate. Work will include all incidentals necessary to complete the project as specified in the Contract Documents Owner will not accept any bid submitted by a Bidder that did not attend this mandatory event. Due to access restrictions, bidders are limited to one vehicle per bidder for the walk-through. Owner will make reasonable accommodations for persons with disabilities who wish to participate. All questions about the meaning or intent of the Contract Documents must be submitted in writing by 3:00 PM Mountain Daylight Time on October 27, 2023 by logging into the "Coal Mine Subsidence Reclamation in Sheridan and Roosevelt Counties," Montana - Contract No. 424009 solicitation located on the bid page on the eMACS site -- selecting "Q & A Board" from the menu on the lower left side of the page, selecting the green "Ask a Question" tab on the upper right side of the page, and entering a question. All questions submitted and their answers will be available for viewing by prospective Bidders. Responses to questions will be posted on or about 5:00 PM Mountain Daylight Time on November 1, 2023. All questions related to the bid process - to include requests to extend the stated submittal deadline, project specifications, or contract terms and conditions MUST be submitted for consideration through the eMACS Q&A Board. Time is of the essence. The Contract time will commence upon issuance of the Notice to Proceed unless otherwise stated therein. Contractor shall pay Owner liquidated damages in the amount of two thousand five hundred dollars ($2,500.00) per day for each day beyond the Contract Time (as adjusted in accordance with the terms of the Contract Documents) that the Work is not complete. Contractor will perform Work during winter months unless a temporary winter shutdown is agreed to in writing between Engineer and Contractor, with final written approval by Owner pursuant to Paragraph 16.05 of the Supplemental Conditions Bidders may select their intent to bid status (optional) and then respond to the prompts, uploading documents, and filling in fields as required. Bidders must respond to all prerequisites and any other instructions regarding uploading documents and providing information. All workers employed for the project must be paid prevailing wages at rates required by the laws of the State of Montana, as shown in the contract documents. Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, disability, or national origin. Subject to the provisions of the Americans with Disabilities Act of 1990, qualified individuals with a disability will not, by reason of such disability, be excluded from this bid solicitation. Persons with disabilities seeking accommodation may contact Owner to make their request. Owner reserves the sole discretion to cancel the contract solicitation for this project, to reject any Bids, to postpone or refuse to award the contract, to consider the Bid of another Bidder, to waive any irregularities, and to take any other action it deems in the best interest of the State of Montana.
