2024 Service and Water Main Contract. Liquidated Damages Contractor and Owner recognize that time is of the essence as stated in Article 2.01 above and that Owner will suffer financial and other losses if the Work is not completed and Milestones not achieved within the Contract Times specified above, plus any changes therein allowed in accordance with Article 4 of the General Conditions. The parties also recognize the delays, expense, and difficulties or impossibility involved in proving, in a legal proceeding, the actual loss suffered by Owner if the Work is not completed on time. The Owner will act as Engineer, assume duties and responsibilities, and have the rights and authority assigned to Engineer in the Contract Documents in connection with the completion of the Work in accordance with the Contact Documents. Bids must be accompanied by Bid security in an amount of five percent (5%) of Bidder's Bid price, and in the form of a Bid bond in a form and from a Surety in a form acceptable to the Authority, to the favor of the Authority, or a certified check made payable to the Monroe County Water before executing the Contract, shall furnish a Performance Bond and a Labor and Materials Payment Bond Payment Bond to the satisfaction of the Authority, both in the sum of the full amount of the Contract, to insure the faithful performance of the Work Authority. The Site is defined in the General Conditions at Article 1.A.37 and identified in the Bidding Documents. By definition, the Site includes rights-of-way, easements, and other lands furnished by Owner for the use of the Contractor. The Authority reserves the right to reject any and all Bids.
