This Project is subject to compliance monitoring and enforcement of prevailing wage requirements by the California Department of Industrial Relations ("DIR") and the San Francisco Office of Labor Standards Enforcement. No contractor or subcontractor may be listed in a bid for a public works project and no contractor or subcontractor may be awarded a contract for public work on a public works project unless registered with the DIR per California Labor Code Section 1725.5 [with limited exceptions from this requirement for bid purposes only under California Code Section 1771.1(a) The objective of the project is to provide contingency-based as-needed replacement of sections of existing sewer pipelines on short notice at locations to be determined within the City and County of San Francisco Bid discounts may be applied as per San Francisco Administrative Code Chapter 14B and Section 2.01 of Attachment 1. The Local Business Enterprise (LBE) subcontracting requirement is 8.00%. The LBE subcontracting requirement can only be met with certified San Francisco Micro and Small-LBEs. The project involves specialty work scopes, including but not limited to lining side sewers with UV Cured Liner and 12"-, 15"-, and 18"-diameter main sewers with CIPP Liner; installation of HDPE for side sewers and for the main sewer by trenchless pipe-bursting installation method; etc. This contract scope of work is almost identical to WW-716, which also had an established LBE requirement of 8%. Further, the LBE participation percentage of the last four (4) SFPUC spot sewer contracts closed out with an average of 7.75% LBE participation. Therefore, an establishment of 8% LBE subcontracting participation requirement for WW-748 is feasible. SFPUC-LBEs cannot be counted towards meeting the LBE subcontracting requirement(s). Prime and Joint Venture level LBE participation cannot be counted towards meeting any of the LBE subcontracting requirement(s). LBE subcontractors must be certified with in the scope of work they are being listed to perform. All Bidders shall submit documented Good Faith efforts with their Bids as directed on Form 2B, except those who exceed the above-stated subcontracting requirement(s) by at least 35%. Refer to Attachment 1. Failure to comply with Chapter 14B requirements may result in a Bid being deemed non-responsive and ineligible for Contract award. Subcontracting opportunities may include, but not limited, to the following major types of work: saw cutting, traffic control and concrete. A Class "A" California Contractors License is required to bid. Furthermore, each listed subcontractor must possess appropriate active licenses for the work each subcontractor will be performing.
