The City of McMinnville will receive sealed bids to overlay various cityidentified existing city streets with 1-1/2" 411-D and 411-E Asphaltic Concrete Surface Hot Mix laid in place and Cold Planning of Bituminous Pavement (1! 1/2"). Bids will be awarded based on the lowest and/or best bid. The City reserves the right to reject any and/or all bids. The City of McMinnville does not discriminate based on race, color or national origin in federal or state sponsored programs, pursuant to Title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d). McMinnville Public Works reserves the rightto haul the mix atthe plant priceforthe supplierto lay in place. Supplier shall guarantee materials and workmanship against defects arising from faulty materials or workmanshipfora period oftwo (2) years. The PublicWorks Directororhis designee will havethe discretion astodeterminethefinal acceptance ofallwork performed bythesupplier. Guaranteewill apply to in-place plant mix asphalt only. I n case oftie bids,theStreets andSanitation Committee reservesthe rightto negotiatewiththe bidders orrejectany and all bids. The rightisreservedasthe interest oftheCityofMcMinnville, Tennessee may require to reject any and all bids received. Thesuppliermustbegin work upon a requestfrom McMinnville PublicWorks withinten (10) days. Ifte suppliercannot begin workwithintheten (10) days, McMinnville PublicWorks reservesthe righttogo tothe nextlowest bidder. In casethe supplier cannotfurnish Hot Mixdepending on the one requested, supplierhastheoption to substitute agradeofHotMix equaltoor betterat noadditional costto McMinnville Public Works. Ifthe supplier does not want to substitute, the Streets and Sanitation Committee reserves the right to obtain the Hot Mix from the vendor who had the next lowest bid. McMinnville's Public Works Director or his designee will supervise all work. He will decide all questions which may ariseastothequality and acceptability ofmaterialsfurnished andwork performed. In allof these matters, the decision ofthe PublicWorks Director orhis designee will befinal and binding. The PublicWorks Director orhis designee will havethe authority to suspendthework, wholly orin part, for such periods as he may deem necessary, due to unsuitable weather, orfor any other conditions considered unsuitable fortheexecution ofthework, orasdeemed to be inthepublic interest.
