The Scope of Work consists of the removal and replacement of one street, 2,946 SY of concrete pavement. Traffic control and other incidental items shall be included as shown in the specifications. Bidders should plan to perform the project in four (4) roughly equal phases in order to maintain access to Belle Meade throughout the project. The anticipated notice to proceed date is July 1, 2024. Approximate Value: $275,000 The Contractor, acting as an independent contractor, shall do everything required by the Contract Documents. Contractor represents and warrants that contractor has special skills which qualify contractor to perform the Work in accordance with the Contract and that contractor is free to perform all such Work and is not a party to any other agreement, written or oral, the performance of which would prevent or interfere with the performance, in whole or in part, of the Work. Not less than the prevailing hourly rate of wages shall be paid to all workers performing under this Contract in this area according to the rates determined by the Department of Labor and Industrial Relations of the State of Missouri. A bid security in the amount of ten percent (10%) of the bid amount must accompany each bid in accordance with the Instructions to Bidders. Each bid shall be accompanied by a certified check or bank draft on a responsible solvent bank or a satisfactory bid bond executed by the bidder and Surety company and payable to the City of Des Peres, Missouri, in the amount of not less than ten percent (10%) of the base bid plus the greatest of the alternate bids. The Contractor shall furnish a Performance Bond in an amount equal to one hundred percent (100%) of the Contract Sum as security for the faithful performance of this Contract and also a Labor and Material Payment Bond in an amount not less than one hundred percent (100%) of the Contract Sum in a penal sum not less than that prescribed by State or local law, as security for the payment of all persons performing labor on the project under this Contract and furnishing materials in connection with this Contract. The Surety shall be a company licensed to do business in the State of Missouri and shall be acceptable to the City. The Performance Bond and the Labor and Material Payment Bond may be in one or in separate instruments. Bidders may request clarification or interpretation of the Bidding Documents by making a written request which shall reach the City at least seven (7) days prior to the date for receipt of bids. Any interpretation, correction or change of the Bidding Documents will be made by Addendum. Interpretations, corrections or changes of the Bidding Documents made in any other manner will not be binding, and bidders shall not rely upon such interpretations, corrections and changes. Addenda will be mailed or delivered to all who are known by the City to have received a complete set of Bidding Documents. Copies of Addenda will be made available for inspection wherever Bidding Documents are on file for that purpose. No Addenda will be issued later than four (4) days prior to the date for receipt of bids, except an Addendum withdrawing the request for bids or one which includes postponement of the date for receipt of bids. Prior to submitting his bid, each bidder shall ascertain that he has received all Addenda issued, and he shall acknowledge receipt of all such Addenda in his bid. The City shall have the right to reject any or all bids, to reject a bid not accompanied by a Bid Bond or by other data required by the Bidding Documents, to reject a bid which is in any way incomplete or irregular and to rebid the Work at a later date if all bids are rejected. All time limits stated in the Contract Documents are of the essence. The Work to be performed under this Contract shall commence within ten (10) days of the date of the written Notice to Proceed from the City to the Contractor and shall be completed within Sixty (60) consecutive calendar days from and including the date of said written Notice to Proceed. Completion of the Work in accordance with the time limits set forth in the Construction Schedule is an essential condition of this Contract. If the Contractor fails to complete the Work in accordance with the Construction Schedule, unless the delay is excusable under the provisions of Article VI hereof, the Contractor shall pay the City as liquidated damages and not as a penalty, the sum of $500.00 for each calendar day the Contractor fails to comply with the Construction Schedule.
