Reference Number 0000263603 Pricing Lump sum The Work to be done under the Contract shall consist of the supply and application of herbicides to various Stormwater Retention Basins in the City of Winnipeg for the period for the period from May 1, 2024 until April 30, 2025, with the option of two (2) mutually agreed upon one (1) year extensions. The City May Negotiate the Extension Option With the Contractor Within Ninety (90) Calendar Days Prior to the Expiry Date of the Contract. The City Shall Incur No Liability to the Contractor as a Result of Such Negotiations. Changes Resulting From Such Negotiations Shall Become Effective on May 1st of the Respective Year. Changes to the Contract Shall Not Be Implemented by the Contractor Without Written Approval by the Contract Administrator. Bidders Are Advised That, in Future, the City May Be Participating in Collaborative Procurement Initiatives With Other Levels of Government. Accordingly, Extensions to This Contract May Not Be Exercised. The Major Components of the Work Are as Follows: (a) Application of Herbicides to Existing Stone Revetments Around Srbs; and (B) Application of Herbicides to Srb Water. The Work Shall Be Done on an as Required Basis During the Term of the Contract. The Type and Quantity of Work to Be Performed Under This Contract Shall Be as Authorized From Time to Time by the Contract Administrator and/or Users. Subject to C7, the City Shall Have No Obligation Under the Contract to Purchase Any Quantity of Any Item in Excess of Its Actual Operational Requirements. Work Shall Commence Within Forty-eight (48) Hours of the Request Order for Herbicide Application Service From the Contract Administrator or User, Except Where Otherwise Agreed to With the Contract Administrator at the Time of Ordering. The Contractor Shall Promptly Report Any Delay or Change to an Agreed Commencement or Completion Date to the Contract Administrator. Work Shall Be Performed on Business Days at Times Determined by the Contract Administrator. Notwithstanding D2.1, in the Event That Operational Changes Result in Substantial Changes to the Requirements for Work, the City Reserves the Right to Alter the Type or Quantity of Work Performed Under This Contract, or to Terminate the Contract, Upon Thirty (30) Calendar Days Written Notice by the Contract Administrator. In Such an Event, No Claim May Be Made for Damages on the Ground of Loss of Anticipated Profit on Work. The Contractor and Their Subcontractors Shall: (a) Comply With the Environmental Management Systems (Ems) Contractors Package of the Wastewater Services Division as Specified in Appendix a. (B) Deliver Ems Awareness Training to Employees and Anyone Who Will Be Working on Projects for the Wastewater Services Division (Wwsd) Through Formal Education, Online Training Interactive Training or Work Experience. (C) Be Aware of Their Obligation as Stated in the Wastewater Services Division s Environmental Policy That Provides Overall Direction for the Wwsds Environmental Performance and Provides a Framework for Setting Environmental Objectives and Targets. This Policy Can Be Found Online Through the City of Winnipeg Wastewater Services Website: Https://www.winnipeg.ca/waterandwaste/sewage/legislation.stm (D) Identify and Understand the Environmental Impacts of Your Work. Environmental Impacts May Include, but Are Not Limited to: (I) Depletion of Natural Resources; (Ii) Conservation Management and Biodiversity; (Iii) Soil Contamination; (Iv) Air Emissions and Pollution; (V) Water Pollution; (Vi) Noise Pollution; (Vii) Spills and Releases; (Viii) Disturbance to Local Community and Fauna; and (Ix) Use of Landfill Spaces and Waste Management. Commercial general liability insurance, in the amount of at least two million dollars ($2,000,000.00) inclusive, with The City of Winnipeg added as an additional insured; such liability policy to also contain a cross-liability clause, contractual liability clause, nonowned automobile liability and products and completed operations cover, to remain in place at all times during the performance of the Work Official bid documents must be obtained from www.merx.com and bid submissions must be done through the Merx platform.
