Provide various pipeline materials on an as-needed basis for the repair and installation of services for the water, sewer and park sites. The equipment covered by this specification shall consist of the: On-Call Purchase of Miscellaneous Pipeline Materials to be used by the City of Garden Grove (CITY). The vendor shall furnish, deliver, and warrant the items according to these specifications and shall include all items and/or accessories not mentioned, but required for operation of the items. The items shall be new, unused and ready for use upon delivery to the City of Garden Grove (City). ALL BIDDERS shall submit with their bid, literature and data as evidence of compliance with the specifications. Liquidity Damages: If the contractor breaches the terms or violates the conditions of the contract, and does not within ten days after notice of such breach, cure such breach or violation, the CITY may terminate the contract for default. The termination notice shall be effective immediately upon delivery and shall explain the nature of the termination. Contractor shall be liable, in the form of liquidated damages for any and all costs incurred by the CITY as a result of such default. Owner Rights: The City of Garden Grove reserves the right to accept or reject any and all bids, or any item or part thereof; or to waive any informality in bids. The City reserves the right to reject any and all bids that do not meet the bid requirements and/or those bids submitted with "alternatives" or "proposed equals" that have not been previously approved by the City.
