Renovation of an educational facility in Box Elder, South Dakota. Completed plans call for the renovation of a educational facility.
Final Completion: September 6, 2024 For Each Day Past the Substantial Completion Date, the Delinquent Prime Contractor Shall Pay to the Owner as a Penalty by Reason of Failure of the Prime Contract to Complete the Work Required of Him/her Within the Agreed Upon Progress Schedule, a Daily Sum Based Upon the Following Schedule. The Penalty Assessed Hereunder Neither Shall Be in Lieu of, Nor Shall Affect Any Other Remedies Available to the Owner as a Result of the Failure to Complete the Work Within The Agreed Upon Progress Schedule. Time is of the Essence in Construing the Terms of the Contract and a Material Consideration Thereof. The Parties Agree That Damages in the Event of Contractors Breach Would Be Difficult to Calculate, and That the Foregoing is A Fair and Reasonable Estimate of the Damages Suffered by the Owner in the Event of Such Breach. Each bid shall be accompanied by a certified check, a cashier's check or draft certified or issued by a state or national bank, in the amount of at least five percent (5%) of the total amount of the bid, payable to the Douglas School District; or in lieu thereof, bidder may furnish a bid bond in the amount of not less than ten percent (10%) of the amount of the bid, such bond to be issued by a surety authorized to do business in the State of South Dakota and payable to the Douglas School District as a guarantee that such bidder will enter into a contract with the School District for the work described in the bid and as specified. The School Board of Douglas reserves the right to reject any part of, or all bids, and to waive any informalities or irregularities therein.
