All bids shall be accompanied by either a bid bond on the “Proposal Bid” form contained in the proposal, executed by a corporate surety company satisfactory to the city of Quincy, or a bank cashier’s check, an irrevocable letter of credit or a properly certified check for not less than 5 percent of the amount bid, or for the amount listed in the specifications. The City Council of Quincy reserves the right to reject any or all bids and to waive technicalities. Prevailing Wages. All wages paid by the Contractor and each subcontractor shall be in compliance with The Prevailing Wage Act (820 ILCS 130), as amended, except where a prevailing wage violates a federal law, order, or ruling, the rate conforming to the federal law, order, or ruling shall govern. The Illinois Department of Labor publishes the prevailing wage rates on its website Liquidated Damages. The contractor is responsible for setting and maintaining a schedule for replacement with the property owner. This schedule may be flexible due to extenuating circumstances (i.e. inclement weather and equipment breakdowns); however, the contractor must make a good faith effort to schedule within a reasonable timeframe. If the contractor fails to make good effort to replace service lines within the agreed upon timeframe, the City will notify them of default. The quantities appearing in the bid schedule are approximate and are prepared for the comparison of bids. Payment to the Contractor will be made only for the actual quantities of work performed and accepted or materials furnished according to the contract. The scheduled quantities of work to be done and materials to be furnished may be increased, decreased or omitted as hereinafter provided If the Awarding Authority requires a Contract Bond, the Contractor or Supplier shall furnish the Awarding Authority a performance and payment bond with good and sufficient sureties in the full amount of the contract as the penal sum.
