MEASUREMENT AND PAYMENT 1. TRAFFIC CONTROL Includes all materials, equipment, and labor required for traffic control including but not limited to preparation of and updates to a traffic control plan to be approved by the Engineer, barriers, signs, flagging, sandbags, permits, coordination with local and state agencies, coordination with UTA, and all other incidentals as required to complete the work as shown on the approved traffic control plans and as directed by the Engineer. Payment also includes on-going maintenance of and adjustments to traffic control and traffic control devices per submitted and approved traffic control plan, replacement of worn or damaged traffic control devices, and on-going coordination with the Engineer and local and state agencies as required. ROAD CLOSURE REQUIREMENTS For all road, sidewalk and trail closures, if applicable, contractors must submit a road closure plan as part of their excavation permit application. The City will create a communication plan that shall be implemented for road closures. The Bid shall be submitted on the BID SCHEDULE bound herein and shall not be removed from the bound volume. Each sealed envelope containing a bid must be plainly marked on the outside as bid for the Williams Ln - I-15 to 800 N Expressway 1400 E - 1240 S to River Bottoms Rd and the envelope should bear on the outside the name of the Bidder, his address, his license number, if applicable, and the name of the project for which the bid is submitted. If forwarded by mail, the sealed envelope containing the bid must be enclosed in another envelope addressed to the OWNER at 40 South Main, Spanish Fork, Utah. Each bid must be accompanied by a Bid Bond payable to the OWNER for five percent of the total amount of the bid. Any bid submitted without a Bid Bond will not be considered or read at the bid opening. As soon as the bid prices have been compared, the owner will return the bonds of all except the three lowest responsible Bidders. When the agreement is executed the bonds of the two remaining unsuccessful Bidders will be returned. The Bid Bond of the successful Bidder will be retained until the Payment Bond and Performance Bond have been executed and approved, after which it will be returned. A certified check may be used in lieu of a Bid Bond. A Performance Bond and a Payment Bond, each in the amount of 100 percent of the contract price, with a Corporate Surety approved by the OWNER, will be required for the faithful performance of the contract. Bidder hereby agrees to commence work under this contract on or before a date to be specified in the Notice to Proceed and to full complete the project by July 25, 2024. Bidder further agrees to pay as liquidated damages, the sum of $500.00 for each consecutive calendar day thereafter as provided in Section 15 of the General Conditions. The OWNER reserves the right to reject any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the OWNER that such Bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein.
