Odessa Downtown Waterline Replacement Question Deadline 03/29/2024 If the question includes the equality or use of products or methods, it must be accompanied by Drawings, Specifications, and any other necessary data to allow the Engineer to make a decision regarding the equality of the product or methods. Information regarding the product must be submitted at least five (5) days prior to bid opening or as indicated in the Specifications to allow for proper review by the Engineer. The City of Odessa reserves the right to award the contract to the "lowest and best responsible bidder". The City reserves the right to reject any or all bids. The City further reserves the right to waive any irregularities in any or all bids and reserves the right to determine which is the most responsive, responsible bidder and to reject or approve the bids. Each bid must be accompanied by a bid security of 5% of the total amount of the bid (bid bond, cashier's check, or approved money order payable to the City of Odessa, Missouri). Work under this contract to be fully complete by 150 consecutive calendar days. The wage rates applicable for this project has been predetermined as required by the State of Missouri Prevailing Wage Law and are set forth in the proposal. The Contractor shall comply with all requirements with regard to immigration and e-verification of citizenship. (3) BID AND PERFORMANCE GUARANTY Each Bid must be accompanied by a Bid Bond, Cashier's Check, or approved Money Order payable to the Owner for 5 percent of the total amount of the Bid. As soon as the bid prices have been compared, the Owner will return the bond, check, or money order of all except the three lowest responsible Bidders. When the Agreement is executed the bonds of the two remaining unsuccessful Bidders will be returned. The Bid Bond of the successful bidder will be retained until the payment bond and the performance bond have been executed and approved, after which it will be returned. A certified check may be used in lieu of a bid bond. A Performance Bond and a Payment Bond each in the amount of 100 percent of the contract price, with a corporate surety approved by the Owner, will be required for the faithful performance of the contract. PERIOD OF PERFORMANCE The work shall be substantially completed within 120 calendar days and completed and ready for final payment within 150 calendar days after the Notice to Proceed, unless the period of completion is extended otherwise by the Contract Documents. LIQUIDATED DAMAGES Owner and Contractor recognize that time is of the essence and that the Owner will suffer financial loss if the Work is not completed within the time specified above, plus any extensions thereof allowed in accordance with the GENERAL CONDITIONS. The parties also recognize the delays, expense, and difficulties involved in proving the actual loss suffered by Owner if the Work is not Substantially Completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay, but not as a penalty, Contractor shall pay Owner Three Hundred Dollars ($300.00) for each day that expires after the time specified above in Paragraph 5 for Substantial Completion until the Work is Substantially Complete. After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the time specified in Paragraph 5 for completion and readiness for final payment or any proper extension thereof granted by Owner, Contractor shall pay Owner Three Hundred Dollars ($300.00) for each day that expires after the time specified for completion and readiness for final payment.
