Site work and paving for a mixed-use development in Barrington, Rhode Island. Completed plans call for site work for a playground / park / athletic field; sidewalk / parking lot; and for paving for a sidewalk / parking lot.

Project Description: Work shall be to provide the Town of Barrington (hereafter "Town") with completed ready-foruse facilities. Scope includes but is not limited to the following: Removal and Replacement of Existing Tennis/Pickleball Courts, Fencing/Guardrail, Walkways, and Parking Area Pavement with New Tennis/Pickleball Courts, New Fencing/Gates and Wood Guardrail, New Walkway, and New Parking Area Pavement. Incidental to these improvements are the installation of erosion control measures, installation of Concrete Pads for Future Site Furnishing installation, new tree plantings, restoration of any disturbed lawn areas, and all work necessary to complete the project to the acceptance of the Town. Any questions or requests for information by prospective Bidders concerning interpretation of the Contract Documents must be submitted in writing to the Awarding Authority and should be in its possession at least ten (10) business days before the date set for the receipt of Bids. The Awarding Authority will post electronically any addenda or written interpretations that it deems necessary at least five (5) business days before the date Bid Bond: A Bid Bond is not required. Performance and Payment Bonds: Performance and Payment bonds in the amount of 100% of the Contract value shall be required from the successful bidder, following issuance of the Notice of Award by the Town. Construction Completion Schedule: Project Construction shall commence in the Spring of 2024. Substantial Completion and Provisional Acceptance of Lawn Areas, including installation of all improvements shall be obtained on or before September 20, 2024. Substantial Completion: As defined by the AIA, and defined herein in accordance with these Specifications, "Substantial Completion" is the stage in the progress of the Work when the Work or designated portion thereof is sufficiently complete in accordance with the Contract Documents so that the Owner can occupy or use the Work or a portion thereof for its intended use. Upon Provisional Acceptance by the Town of all improvements, including, but not limited to Acceptable Lawn Establishment, Contractor and Owner will monitor lawn until Final Acceptance (a minimum period of one (1) month). During this time (upon Provisional Acceptance), Maintenance of Project Components, including lawn areas,shall be conducted by the Contractor. Target Final Acceptance Date: October 25, 2024. Contractor and Owner recognize that time is of the essence of this Agreement and that Owner willsuffer financial lossif the Work is not completed within the times specified above, plus any extensions thereof allowed by mutual agreement between Owner and Contractor due to unforeseen circumstances such as non-conducive construction weather, disaster, or acts of God. The parties also recognize the delays, expense, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead ofrequiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty), Contractor shall pay Owner $250 for each day that expires after the time specified above for Substantial Completion until the Work is substantially complete. After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Time or any proper extension thereof granted by Owner, Contractor shall pay Owner $250 for each day that expires after the time specified above for completion and readiness for final payment until the Work is completed and ready for final payment. The Town reservesthe right to reject any or all Bids, including without limitation the right to reject any or all non-conforming, non-responsive, unbalanced or conditional bids, as the best interests of the Town may require. The Town further reserves the right to rebid any or all portion(s) of a bid that it feels may be non-competitive.
