Site work and paving for a civil project in Osage Beach, Missouri. Completed plans call for site work for a water / sewer project; road / highway; and for paving for a road / highway.

Questions in regards to Bid Documents will be received until 4:00 p.m., Monday May 13, 2024. The work ofthis contract includes installation of new gravity sewer piping and manholes. Improvements include 605 L.F. of 8-inch diameter gravity sewer PVC piping, installation of new man holes, asphalt pavement repair, and new sewer connections into existing piping with doghouse manholes. Work shall include any other incidental items and work described in the Project Manual, or reasonably inferable therefrom. Bids must be submitted on the Bid Forms provided in the bound Bidding Documents Package and be accompanied by the bidder's certified check or bid bond in the amount of five percent (5%) ofthe total bid. A performance bond will be required ofthe successful bidder. The successful bidder will also be required to obtain a contractor's license and submit a certificate ofinsurance for workers' compensation. The prevailing hourly rate of wages, as determined by the Federal Wage Determination and/or the Industrial Commission of Missouri, Annual Wage Order #30, including amendments, will be complied with on this project, and not less than the prevailing hourly rate of wages as found by the agencies or Court of Appeals shall be paid to all workmen performing work under this contract. No bidder may withdraw his bid within 60 days after the actual date ofthe opening thereof. Any Bidder or equipment supplier whose firm or affiliate is listed on the General Services Administration (GSA) publication entitled "Lists of Parties Excluded from Federal Procurement or Non-procurement Programs" will be prohibited from the bidding process. Anyone submitting a bid who is so listed will be determined to be a nonresponsiv.e Bidder in accordance with 40 CFR 31. Bidders on this work will be required to comply with the President's Executive Order No. 11246 in regard to non-discrimination in employment. Enrollment in Federal Work Authorization program Bidders are informed that pursuant to Section 285.530, RSMo, as a condition ofthe award ofany contract in excess of five thousand dollars($5,000.00), the successful bidder shall, by sworn affidavit and provision ofdocumentation, affirm its enrollment and participation in a federal work authorization program with respect to the employees working in connection to the contracted services. Successful biddersshall also sign an affidavit affirmingthat it does notknowingly employ any person who is an unauthorized alien in connection to the contracted services. Safety training Bidders are informed that the Project is subject to the requirements of Section 292.675, RSMo, which requires all contractors orsubcontractors doing work on the Project to provide, and require its on-site employeesto complete, a ten (10) hour course in construction safety and health approved by the Occupational Safety and Health Administration ("OSHA") or a similar program approved by the Missouri DepartmentofLaborand IndustrialRelations which is at least as stringent as an approved OSHA program. The training must be completedwithin sixty (60) days ofthe date work on the Project commences. On-site employees found on the worksite without documentation ofthe required training shall have twenty (20) days to produce such documentation. Authorized employees Contractor acknowledges that Section 285.530 RSMo, prohibits any business entity or employer from knowingly employing, hiring for employment, or continuing to employ an unauthorized alien to perform work within the state of Missouri. Contractortherefore covenantsthat it is not knowingly in violation ofsubsection 1 ofSection 285.530 RSMo, and that it will not knowingly employ, hire for employment, or continue to employ any unauthorized aliens to perform work on the Project, and that its employees are lawfully eligible to work in the United States. Authorized employees Contractor acknowledges that Section 285.530 RSMo, prohibits any business entity or employer from knowingly employing, hiring for employment, or continuing to employ an unauthorized alien to perform work within the state of Missouri. Contractortherefore covenantsthat it is not knowingly in violation ofsubsection 1 ofSection 285.530 RSMo, and that it will not knowingly employ, hire for employment, or continue to employ any unauthorized aliens to perform work on the Project, and that its employees are lawfully eligible to work in the United States. The City reservesthe right to reject any and all bids, to waive informalities or irregularities, and to determine the lowest responsive and responsible bidder, and to award the contract on that basis. All Bidders must agree that such rejection shall be without liability on the part of the City for any damage or claim brought by any Bidder because of such rejection, norshall theBidderseek any recourse ofany kind against the City because ofsuch rejection. The filing ofany Bid in response to this invitation shall constitute an agreement ofthe Bidder to these conditions. All disputes under this contract and any litigation resulting under this contract shall be filed, tried, remain and be ultimately resolved in the Circuit Court ofCamden County on any appeal therefrom within the courts ofthe State of Missouri. The contractor hereby knowingly, intelligently and voluntarily agrees and waives any and all removalrightsto federal court or the right to litigate the claim or any part thereofin courts of any other state for any reason.
