The Proposal shall be accompanied by a certified or cashier's check drawn on a solvent Missouri bank or trust company made payable to the City of Tipton, or a Bid Bond issued by a surety licensed to conduct business in the state of Missouri and appearing on the U.S. Treasury Department's most current list (Circular 570, as amended), in the amount of not less than five percent (5%) of the total bid. The Bid Bond may be retained by the City ofTipton, as a guaranty that if the Proposal is accepted, the bidder will execute the Contract and file an acceptable Performance Bond and Payment Bond within ten (10) days after the award of the Contract. Bidders on this Work will be required to comply with the Copeland (Anti-Kickback) Act, and the Contract Work Hours and Safety Standards Act, as indicated in the Contract Documents. The award of Contracts on this project shall be predicated upon competitive bidding, and satisfactory performance of past work with the City. Said Bidder shall be determined for the Contract by summarizing the applicable low base bids and selection by the City Council based on past performance of work. The City of Tipton reserves the right to reject any and all bids and to waive all informalities in the bids. No bids may be withdrawn for a period of ninety (90) days subsequent to the specified time for receipt of bids. TIME OF COMPLETION: The time of completion of the work as set forth in the Proposal is a basic consideration of the Contract. It will be necessary that the bidder satisfy the Owner of his ability to complete the work within the stipulated time. The attention of the bidder is called to the provisions of the General Conditions relative to delays and extensions of time and relative to liquidated damages. The Engineer will consider such questions submitted in writing at least 10 days prior to bid opening. If the question includes the equality or use of products or methods, it must be accompanied by drawing, specifications, and any other necessary data to allow the Engineer to make a decision regarding the equality of the project or method. Such requests will only be considered by general contractors known to the bidding on the project.
