Renovation of a multi-residential development in Roseville, Michigan. Working plans call for the renovation of a multi-residential development.

**As of May 16, 2024 no bids received for this project. Architect Estimate: $300,000. DESCRIPTION Full replacement of shingle roof and associated work. Partial replacement of gutters and downspouts. Bid alternate for full replacement of gutters and downspouts. BID GUARANTEE AND CONTRACT SECURITY Each bid proposal shall be accompanied by a certified check, bank draft or satisfactory bid bond in an amount of 5% of the maximum bid amount. Checks shall be made payable to "Roseville Housing Commission". Bids may not be withdrawn for a period of sixty (60) calendar days after receipt of bids. The successful bidder will be required to furnish the required insurance and bond certificates . RIGHTS OF THE OWNER The Owner reserves the right to reject any or all proposals and to waive irregularities in bidding, or to accept the lowest responsible proposal that, in the opinion of the Owner, will serve his best interest. WITHDRAWAL OF BIDS No bidder may withdraw his proposal within one hundred twenty (120) calendar days after the date set for opening thereof. This time frame may be adjusted through material agreement between the Owner and Contractor. AWARD OF CONTRACT The right to accept any bid, to reject any or all proposals and to waive irregularities in bidding is reserved by the City of Rochester. Portions of this Contract may be deleted due to unforeseen circumstances without compensation. Acceptance of any bid does not constitute a binding agreement until a written Contract is signed by both parties. DAVIS-BACON/PREVAILING FEDERAL WAGE RATES P.L. 111-88 requires compliance with the Davis Bacon Act and adherence to the current U.S. Department of Labor Wage Decision. Attention is called to the fact the not less than the minimum salaries and wages as set forth in the Contract Documents (see Wage Decision include herein) must be paid on this project. The Wage Decision, including modifications, must be posted by the Contractor on the job site. A copy of the Federal Labor Standards Provisions is included and is hereby a part of this Contract. BUY AMERICAN AGREEMENT The Contractor acknowledges to and for the benefit of the Roseville Housing Commission ("Purchaser") and the U.S. Department of Housing and Urban Development (HUD) that it understands the goods and services under this Agreement are being funded with monies made available by the United States Federal Government and such law contains provisions commonly known as "Build America, Buy America (BABA);" that requires all roofing products used in the project be produced in the United States ("BABA Requirements") including materials provided by the Contractor pursuant to this Agreement. The Contractor hereby represents and warrants to and for the benefit of the Purchaser and HUD that (a) the Contractor has reviewed and understands the BABA Requirements, (b) all materials used in the project will be and/or have been produced in the United States in a manner that complies with the BABA Requirements, unless a waiver of the requirements is approved or HUD made the determination in writing that the BABA Requirements do not apply to the project, and (c) the Contractor will provide any further verified information, certification or assurance of compliance with this paragraph, or information necessary to support a waiver of the BABA requirements, as may be requested by the Purchaser. Notwithstanding any other provision of this Agreement, any failure to comply with this paragraph by the Contractor shall permit the Purchaser or HUD to recover as damages against the Contractor any loss, expense or cost (including without limitation attorney's fees) incurred by the Purchaser or HUD resulting from any such failure (including without limitation any impairment or loss of funding, whether in whole or in part, from U.S. Government or any damages owed to HUD by the Purchaser). While the Contractor has no direct contractual privity with HAD, as a lender to the Purchaser for the funding of its project, the Purchaser and the Contractor agree that HUD is a third-party beneficiary and neither this paragraph (nor any other provision of this Agreement necessary to give this paragraph force or effect) shall be amended or waived without the prior written consent
