Title VI of the Civil Rights Act of 1964 - No person shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance. Title IX of the Education Amendments of 1972 - Prohibits discrimination based on gender in all programs or activities that receive Federal financial assistance. Title IX also includes same gender harassment as well as student-to-student harassment. Governing Law/Jurisdiction: The Agreement shall be governed by the laws of the State of Tennessee. Any action brought in law or in equity to enforce any provision of the entire Agreement shall be filed in the appropriate state court in Hamilton County, Tennessee. In any action to enforce this Agreement, the prevailing party shall be entitled to recover its costs and expenses, including reasonable attorney's fees. By submission of a proposal and acceptance of a Purchase Order or Contract, Vendor hereby agrees to adhere to Governing Law/Jurisdiction requirements as described herein. CONTRACT PERIOD 1.1 CONSTRUCTION TERM: From the Notice to Proceed or the Purchase Order date, whichever applies: 120_ calendar days to substantial completion, 14_ calendar days from substantial completion to final completion (total contract days 134_). SUMMARY OF SCOPE 1.1 Hamilton County Schools (HCS) seeks to contract with a qualified, experienced, and professional Vendor to construct Tennis Court Assemblies as detailed by and within the Contract Documents prepared by DH&W Architects. DETAILED SCOPE OF SERVICES 2.1 The services and products provided by the Vendor shall include, but not be limited to the following provisions: 2.1.1 Contractor shall be responsible for Payment Invoicing, maintaining a Project Schedule, coordinating the Work, maintaining the temporary Stormwater components such as silt fencing, temporary seeding, waddles, etc. 2.2 The detailed scope of work and Contractor responsibilities are further defined within the Project Manual/Specifications and project plans provided as part of the solicitation. It is the responsibility of the Vendor to review and fully understand all associated project documents. All questions pertaining to this solicitation must be submitted electronically to doe_purchasing@hcde.org no later than 8 calendar days prior to the Opening/Due date designated herein. Failure to submit a question in the timeframe indicated above may result in the question going unanswered at the discretion of HCS. An extension to the opening date does not guarantee an extension to the question deadline period. Such will be communicated in associated addendum posting. It is the sole responsibility of the Vendor to ensure they receive/obtain all solicitation related documentation. The Project consists of clearing, grading and construction required to install new Tennis Court assemblies. This requires installlation of utilities, repair of existing roadway where utilities cross Sam Powell Trail, maintenance of erosion control features, relocation of a portion of a walking trail, relocation of storage containers to a new location no more than 1/2 mile from current location, installation of new construction, including all components of Tennis Court Assemblies, seeding and stormwater management. Refer to drawings and Alternates for more information.
