The project base bid includes all work required for the milling and paving of approximately 5 miles of 2 to 5 inch HMA full-width overlay with some level-up sections on various roadways within the City of Terrell, Texas. Proposals shall be accompanied by a cashier's or certified check upon a national or state bank in an amount not less than five percent (5%) of the total price for the BASE BID, payable without recourse to the Owner, or a bid bond in the same amount from a surety authorized under the laws of the State of Texas to act as a surety on bonds for principals. Amount represents a guarantee that the Bidder will enter into a contract and execute Performance and Payment Bonds within ten (10) days after notice of award has been provided o Contractor. Said bid guarantee shall be made payable to City of Terrell. The notice of award of contract shall be given to the successful bidder within sixty (60) days following the bid opening. The successful bidder must furnish a Performance Bond upon the form provided in the amount of one hundred percent (100%) of the contract price including alternates selected for construction, and a Payment Bond upon the form provided in the amount of one hundred percent (100%) of the contract price including alternates selected for construction from a surety authorized under the laws of the State of Texas to act as a surety on bonds for principals. The City of Terrell reserves the right to reject any or all bids, to waive irregularities in the bids and bidding deemed to be in the best interests of City of Terrell, and to reject nonconforming, nonresponsive, or conditional bids. The City reserves the right to award any of the alternatives provided for in this project or none as deemed in the best interest of the City. The City reserves the right to negotiate with any and all bidders that submit bids per the Texas Professional Services Procurement Act and Office of Management and Budget Circular No. A-102. Section 3. Residents and Business Concerns, Minority Business Enterprises, Small Business Enterprises, and Women Business Enterprises are encouraged to submit bids. A maximum of 45 calendar days will be allowed for substantial completion of the construction and 15 days to final construction acceptance of the base bid.
