No proposal will be considered unless accompanied by one of the following forms of bidder's security: cash, a cashier's check, or a certified check on a bank insured by the Federal Deposit Insurance Corporation, or a bidder's bond executed by an approved surety insurer, made payable to the Director of Finance in the manner, form, and amount required by Section 103D-323 of the Hawaii Revised Statutes. The proposal guaranty shall be equal to at least five percent (5%) of the total amount of the bid submitted. Bidders are required to comply with the newest procurement code, HRS, Chapter 103-D, any rules and regulations and policy directives issued with respect to Chapter 103- D and any amendments thereof. The Director reserves the right: A. To accept or reject any or all offers and to waive any minor or inadvertent discrepancy in the bid documents; B. To withhold confirmation of award for a period of sixty (60) calendar days from the date of bid opening; and C. To increase or decrease the quantity any time prior to award, and the vendor agrees not to claim loss of profit from this change The Award of Contract is conditioned upon the amount of funds available for the contract. A contract shall be awarded to the lowest responsible and responsive bidder, based on the lowest Amount for Comparison of Bids. Incomplete, conditional, or irregular bids will be rejected. A Performance Bond WILL be required.
