**As of June 5, 2024, project was awarded to Schoenfelder Construction, awarded amount is $284,525.50.** Furnishing all materials, labor, supervision, tools and equipment necessary or incidental to the work for Railroad and Main Sewer Improvements. Bond Notes: Each bid must be accompanied by a certified check, cashier's check or bank draft issued upon a National or State Bank made payable to the City of Mitchell, South Dakota in an amount of no less than five percent (5%) of the bid, or in lieu thereof, a bid bond for ten percent (10%) of the amount of the bid, such bond to be issued by a surety authorized to do business in the State and countersigned by a resident agent payable to the Finance Officer of the City of Mitchell, South Dakota. The Bid Security must accompany the proposal as a guaranty the bidder will enter into a contract within ten (10) days after the notice of award is delivered to the contractor. Checks of the unsuccessful bidders will be returned after award of the contract. Owner Rights: The City of Mitchell reserves the right to waive any informalities or to reject any or all bids. Owner reserves the right to reject any and all Bids, to waive any and all informalities, and to negotiate contract terms with the Successful Bidder, and the right to disregard all nonconforming, nonresponsible, or conditional Bids. Owner reserves the right to reject the Bid of any Bidder who does not pass any such evaluation to the Owner's satisfaction. LIQUIDATED DAMAGES : Provisions for liquidated damages, if any, are set forth in the Agreement. Accordingly, instead of requiring any such proof, OWNER and CONTRACTOR agree that as liquidated damages for delay (but not as a penalty) CONTRACTOR shall pay OWNER $450 for each calendar day that expires after the time specified in Paragraph 3.1 for substantial completion until the Work is substantially complete.
