1. Weekly residential garbage pickup and disposal (see Ordinance 8.04). Collection of large items such as white goods picked up at residences leaves in bags and branches in 4-foot bundles to be included in bid price. 8.04.070 Collection shall not be between the hours of seven p.m. one day and seven a.m. the next day. 2. To be included in contractors bid price and to be picked up: a. All city owned dumpsters (5): City Hall & City Shop, Swim Pool, RV Park and Ball Diamond b. One city cleanup per year in the spring with collection arrangements to be coordinated with the Public Works Supervisor. 3. Bid will be a three (3) year contract. Payments will be made in twelve (12) monthly installments per year by the 10th of the month following the service. 4. Contractor will not be responsible for billing or collection of individual assessments. This will be done through the City Finance Office. The City Finance Office will bill for 542 collections monthly. 6. Contractor shall offer a contract with commercial businesses within the City. 7. Trucks collecting garbage from residential occupants shall not exceed the maximum capacity of eighteen (18) yards. Trucks which provide garbage collection service to commercial establishments shall not exceed a maximum capacity of twenty-six (26) yards. All such trucks will have a watertight metal tank and shall be covered so that not more than one-half of any truck can be uncovered at any one time. The cover shall be fully closed while the truck is traveling between place of collection and place of transfer disposal. 8. The contractor shall comply with all Federal, State, County, and City laws, regulations, ordinances and permits. 9. Successful bidder will be required to furnish a performance bond issued by an authorized South Dakota Bonding Co. in the amount of $50,000.00. A copy of the Bond or a letter of commitment from an authorized bonding company must be provided with bid. 10. Successful bidder will be required to carry liability insurance naming the City as additional insured in a minimum amount of $1,000,000.00 combined single limits. Proof of insurance or a letter of commitment from an authorized insurance carrier must be provided with bid. 11. The Contractor shall buy compensation insurance for all of the employees in accordance with the workman's compensation statute of the State of South Dakota. 12. The Contractor shall assume responsibility for all loss and damage caused by his individual negligence, negligence of employees, and negligence of independent contractors hired by him to carry out the terms and conditions of this contract. The Contractor shall indemnify the City against any claim for damages caused by negligence of the Contractor or his employees or independent contractors hired by him to complete the terms and conditions of this contract, and upon request at any time shall cause the City to be named as the additional insured in the insurance policies required by the Contractor under this contract. 13. The Contractor expressly contracts and agrees that he is an independent contractor solely responsible for the purchase, maintenance and servicing of his equipment, and said Contractor shall furnish all equipment and human resources necessary to perform this contract. Neither the Contractor nor anyone employed by him shall be, act or purport to act, or be deemed to be the City's agent, representative, employee or servant. 14. The Contractor shall indemnify and save the City (including its employees, the Council, its consultants and legal counsel) harmless from and against all expense, loss or liability caused by or resulting from the failure of the Contractor to fully comply with applicable federal, state or local laws, statutes, regulations or governmental directives which regulate handling, collection, hauling or disposal of garbage hereunder and from any and all claims, suits, liability or loss of or damage to any property or persons (including death) caused by any negligent or willful act of the Contractor or his subcontractors during the handling, collection, hauling, transportation, storage or disposal of garbage hereunder. 15. The City reserves the right to revoke and cancel said contract on 30 days notice in the event of default. 16. Bids must be on official City of Britton bid sheets. Call or stop at City Hall to get bid sheet. The City reserves the right to reject any and all bids, to waive any informality in the bidding and to award the contract to the lowest responsible bidder.
