The purpose of the Request for Proposal (RFP or Solicitation) is for the University of Maryland, Baltimore (UMB) to procure On Call Construction Management at Risk Services (CMAR) for design and construction of various projects, as they may occur. Work will primarily be performed at the University of Maryland Baltimore (UMB). UMB may use this for projects it manages on other campuses in the region. At UMB CFSA discretion, other institutions in the University System of Maryland, particularly those in the Baltimore region (Towson University, Coppin State University, University of Baltimore, and UMBC) may use the resulting contracts. Individuals not on an attendee list are still welcome, though will experience a lengthier check-in process. Please have ID. Parking: Grand Garage is directly across the street at 5 N Paca St All questions on this procurement are to be directed in writing via email to the following individual: Points of Contact: Christina Blair, cblair@umaryland.edu The purpose of this solicitation is to award multiple multi-year contracts to CMAR Contractors to provide pre-construction and construction services for projects as they arise. UMB anticipates that it will elect to utilize the resulting Framework Contract(s) for a variety of assignments and projects due to the ease of using such contract(s) including, but not limited to, favorable pricing. The contract(s) will generally be used for projects between $1-15 million, with some projects valued up to $25M and most projects under $5M The university will generally select the next contractor in rotation, but reserves the right to go out of rotation if this is the university's benefit (see item 2.1.12 for further implementation details). The estimated annual dollar volume for work to be performed under the contract is $25M total. All proposers are advised that this amount is only an estimate and all proposers further understand and agree that by providing such estimate, the University makes no guarantee that any or that all of the estimated work will be assigned to the selected On-Call CMAR firms. The University anticipates the first year of the contract to be slow, with one to two projects awarded per year following UMB's Office of Construction and Facilities Strategic Acquisitions will manage the resulting Framework Contracts and, in most cases, UMB's Office for Facilities and Maintenance will manage the subsequent task orders, unless delegated by UMB to another USM institution. Any USM institution may only utilize the resulting contract with express approval of UMB. Whenever a project is done on one of the USM campuses under this contract, the Amendments to the UMB General Conditions for that campus apply There shall not be any acceptance terms and conditions included in the proposal submission. Goals and subgoals will be set for each task order at $200,000 or above as determined by UMB CFSA. Response to this RFP will consist of: A. Phase 1 Proposal: This phase focuses on relevant experience delivering projects of this size and type to institutional owners in a collaborative construction management delivery method. Open to any firm, who wishes to participate. B. Phase 2 Proposal: UMB will invite successful firms from Phase 1 to move forward. This phase includes 2 components: (1) Written proposal addressing solutions to deliver projects to UMB (2) Oral Interview C. Cost Proposal: Upon invitation only. UMB will not open Cost Proposals until after technical evaluation is complete. See Section 4 Articles 1-4 for further details regarding the proposal requirements and procurement phases. UMB's Construction & Facilities Strategic Acquisitions (UMB CFSA) will manage the resulting contracts. UMB CFSA will also handle administration of task orders, and project procurement functions, unless authorized/delegated to a using campus. UMB's Facilities and Operations (UMB F&O) will manage the project(s), unless project management is delegated by UMB to the using campus. USM Client institutions served by the University of Maryland, Baltimore in the Baltimore Region include the University of Maryland, Baltimore County (UMBC), Coppin State University (CSU), Towson University (TU), and the University of Baltimore (UB) Deadline for questions :Thursday, June 20, 2024 UMB target date for issuing addendum including question responses:Tuesday, June 25, 2024 UMB identifies firms moving forward to Phase 2 :Friday, July 19, 2024 Phase 2 Submittal Monday, August 5, 2023 on or before 2:00 p.m. Oral Interviews Wednesday, August 14, 2024 and Thursday, August 15, 2024 Cost Proposal due Thursday, August 22, 2024 on or before 2:00 p.m. BPW approval Wednesday, October 2, 2024 (Projected) Commencement of services As required after selection and execution of Framework agreement. With submission of the Task Order Cost Proposal in accordance with this RFP, all proposers are required to comply with the following proposal security: A. Task Order Cost Proposals for this Contract, if based on a project, will utilize sample projects therefore, a Bid Bond is not required with this On Call CMAR solicitation cost submittal. A Bid Bond will be required for each individual Task Order exceeding $100,000. The Bid Bond must be issued by a surety company licensed to issue bonds in the State of Maryland. The bond must be in an amount not less than five percent (5%) of the total amount of the Task Order Cost proposal (sum of the fees and reimbursables) and shall be in the form specified (see sample in Attachment F). B. If a specific project/task order is $100,000 or more, the proposer shall furnish Performance and Payment Bonds, each in the amount of one hundred percent (100%) of the project/task order including executed Change Orders, in the form specified (see samples in Attachment F). These must be provided at the time of the signing of the purchase order to proceed for the applicable project/task order and prior to the start of any work. Please note that as part of the Technical Proposal, a Proposer must indicate its capability of obtaining the necessary bonds. C. Cost for any bonds should be included in the Contractor's Task Order proposal. This does not apply to the cumulative total of work in progress under a given on call/time and material not to exceed contract but rather to a single project. D. Acceptable security shall be limited to: a) a bond in a form satisfactory to the State underwritten by a surety company authorized to do business in the state; b) a bank certified check, bank cashier's check, bank treasurer's check, cash, or trust account; c) pledges of securities backed by full faith and credit of the United States government or bonds issued by the State of Maryland; d) Irrevocable letters of credit in a form satisfactory to the Attorney General and issued by a financial institution approved by the State Treasurer; and e)the grant of a mortgage or deed of trust on real property located in the State when it is satisfactory to the procurement officer, the face amount of the instrument does not exceed 75% of the contractor's equity interest in the property, and the assignment of the mortgage or deed or trust is recorded in the county land records pursuant to Real Property Article, 30193, Annotated Code of Maryland. E. Assistance in obtaining bid, performance and payment bonds may be available to qualifying small businesses through the Maryland Small Business Development Financing Authority (MSBDFA). MSBDFA can directly issue bid, performance or payment bonds up to $750,000. MSBDFA may also guaranty up to 90% of a surety's losses as a result of a contractor's breach of contract. MSBDFA's exposure on any bond guaranteed may not, however, exceed $900,000. Bonds issued directly by the program will remain in effect for the duration of the contract, and those surety bonds that are guaranteed by the program will remain in effect for the duration of the surety's exposure under the contract. To be eligible for bonding assistance, as business must first be denied bonding by at least one surety in both standard and specialty markets within 90 days of submitting a bonding application to MSBDFA. The applicant must employ fewer than 500 full-time employees or have gross sales of less than $50 million annually, have its principal place of business in Maryland or be a Maryland resident, must not subcontract more than 75 percent of the work, and the business or its principals must have a reputation of good moral character and financial responsibility. Finally, it must be demonstrated that the bonding or guarantee will have a measurable economic impact, through job creation and expansion of the state's tax base. Applicants are required to work through their respective bonding agents in apply for assistance under the program. Should the Proposer to whom the Task Order contract is awarded fail or be unable to execute the contract, for any reason, within ten (10) days after notification of award, then an amount equal to the difference between the accepted price, and that of the proposer to whom the award subsequently is made shall be paid to the University as liquidated damages. G. The Proposer to whom a contract in excess of $100,000.00 is awarded also must furnish Performance and Payment Bonds, each in the amount of one hundred percent (100%) of the Guaranteed Maximum Price (GMP) including executed Change Orders, in the form specified (see samples in Attachment F). These must be provided at the time of the signing of the GMP contract amendment and prior to the start of any work. Please note that as part of the Technical Proposal, a Proposer must indicate its capability of obtaining the necessary bonds. H. Evaluation of a Request for Proposal takes a considerable length of time. Maryland State Law does not permit any information regarding the evaluation to be released prior to the award. The award date is the date of approval by the Board of Public Works. I.Bid Bonds remain in effect a minimum of one hundred and twenty (120) days from the due date of the Cost Proposals as all Cost Proposals shall remain firm for one hundred twenty calendar days (refer to Item 30 below).
