The Project includes, without limitation, furnishing all necessary labor, materials, equipment, and other incidental and appurtenant Work necessary to satisfactorily complete the Project, as more specifically described in the Contract Documents. This Work will be performed in strict conformance with the Contract Documents, permits from regulatory agencies with jurisdiction, and applicable regulations. The quantity of Work to be performed and materials to be furnished are approximations only, being given as a basis for the comparison of Bids. Actual quantities of Work to be performed may vary at the discretion of the City Engineer. Work includes a citywide roadway pavement rehabilitation project including construction of cold-milling asphalt concrete pavement and re-paving with hot mix asphalt (HMA), clearing and grubbing, removal and preparation of native subgrade materials, removal and disposal of Macadam base materials where indicated, localized pavement repairs, replacing impacted traffic striping, markings, and loop detectors, curb painting, replacing damaged curb and gutter, adjusting utility frames and grates, utility coordination, and providing temporary traffic control in conformance with Contract Documents and applicable permits and regulations. The Contractor shall complete all Work under the Contract within ninety (90) working days from the date specified in the Notice to Proceed. Each bid must be accompanied a satisfactory bid bond executed by the bidder and an acceptable surety, in an amount equal to ten percent (10%) of the total aggregate bid amount. The successful bidder will be required to furnish and pay for performance and payment bonds acceptable to the Agency. City reserves the right to interpret or change any provisions of this RFQ/RFP at any time prior to Wednesday, July 12, 2024. Such amendments, if any, shall be issued as written Addendum/Addenda to this Notice Inviting Bids. Bidder shall be a licensed contractor pursuant to the Business and Professions Code and shall be licensed in the appropriate classification(s) of contractor's license(s), for the work bid upon, and shall maintain the license throughout the duration of the Contract. Bidders must possess a current State of California Class A or C-12 Contractor's License or a combination of Specialty Contractor's Licenses sufficient to cover all of the work to be performed by the prime contractor. Agency will accept bids only from Bidders that (along with all subcontractors listed in the bid) are currently registered and qualified to perform public work pursuant to Labor Code Section 1725.5. Subject to Labor Code Sections 1771.1(c) and (d), any Bid from an unregistered Bidder or that includes an unregistered subcontractor shall be returned and not considered; provided that if Bidder is a joint venture (Business & Professions Code Section 7029.1) or if federal funds are involved in the Contract (Labor Code Section 1771.1(a)), Agency may accept a noncomplying Bid provided that Bidder and all listed subcontractors are registered at the time of contract award. The Agency reserves the right to reject any or all bids, to waive any irregularity(ies), and to take all bids under advisement for a period of sixty (60) calendar days after the date the bids are publicly opened.
