The Ector County ISD (ECISD) is soliciting a Request for Proposal (RFP) for Job Order Contracting Services for Asphalt. ECISD intends to award multiple vendors contracts based on the district's needs, projects, and time constraints. All awarded suppliers are treated as NON-EXCLUSIVE contracts, by which multiple vendors may be designated as suppliers for the services covered under the terms of the contract for the duration of said contract. Vendors will be used on an as needed basis throughout the district to provide services based on the district's needs. This RFP will not be a guarantee of the issuance of any Job Orders, but to establish you as a Certified Vendor to do business with ECISD. The Work will be set forth in the Detailed Scope of Work for individual Job Orders. The Contractor is required to complete each Detailed Scope of Work for the Job Order Price within the Job Order Completion Time. The Contractor will be required to perform Work at any site or facility under the jurisdiction of the Owner. Refer to the JOC Supplemental Conditions for an overview of the JOC procurement system, contract specifics, JOC definitions, and procedure for ordering work. Question Deadline 07/17/2024 at 1:00 PM CT. All questions regarding this RFP (or the process) must be addressed in written format through electronically. Response to questions will be posted electronically by 5:00 p.m. on Friday, July 19, 2024. If an addendum is needed it will be posted by the deadline for questions. Proposal Awarded (Anticipated) August 2024 Awards Posted (Anticipated) September 2024 Contract Begins At Superintendent's Discretion It is the intent of Ector County ISD to award multiple contracts to fulfill the requirements of this RFP. A two-year contract is contemplated with an option for three (3) additional one-year extensions, subject to the annual review and approval by the Board of Trustees. Both parties must agree, in writing, for each annual extension. All Job Orders issued during any term of this Contract shall be valid and in effect notwithstanding that the Detailed Scope of Work may be performed, payments may be made, and the guarantee period may continue, after such period has expired. All terms and conditions of the Contract apply to each Job Order. If the Respondent requires the district to sign a separate contract, that contract must be included with the proposal submittal. Any separate contracts must include all provisions of this RFP, either by reference or specific inclusion. The contents of the RFP shall become part of any resulting agreement. The terms and conditions specified in this RFP shall be used as a basis for a contemplated agreement. Failure of a Respondent to accept these obligations may result in rejection. Any damages accruing to the district as a result of a Respondent's failure or refusal to execute an agreement may be recovered from the Respondent. The District may negotiate with a firm or firms, judged to be the most capable, competent and qualified, to arrive at a fair and reasonable fee for the services required. However, the District reserves the right to recommend award without negotiations. The District reserves the right to accept or reject any or all offers, to waive informalities, and to accept offers that are deemed by the District to be most favorable to the District. While the District has every intention to award a contract as a result of this RFP, issuance of the RFP in no way constitutes a commitment by ECISD to award a contract. Upon a determination such actions would be in its best interests, the district in its sole discretion reserves the right to: a) waive any formality; b) cancel or terminate this RFP; c) reject any or all proposals received in response to this document; d) waive any undesirable, inconsequential, or inconsistent provisions of this document, which would not have significant impact on any proposal; not award, or if awarded, terminate any contract if ECISD determines adequate District funds are not available. e) ECISD reserves the right to select multiple suppliers. f) ECISD reserves the right use multiple suppliers simultaneously. Liquidated Damages: If the successful Offeror fails to deliver or defaults on this contract within the time specified in the contract, the Offeror shall pay (or have withheld from payments due), at the option of ECISD, to ECISD as liquidated damages $300 per delivery order. The Offeror agrees that this is a reasonable cost to compensate ECISD for time and effort involved in procuring replacement services, which costs would be difficult, if not impossible, to compute with certainty and does not constitute a penalty. Assessment of liquidated damages does not preclude ECISD from seeking and obtaining other remedies as set forth in the solicitation or any other remedy at law or in equity available to ECISD. The Base Term of the Contract is two-years. There are three bilateral Option Terms. Both parties must agree to extend the Contract for an Option Term. The duration of each Option Term is one year.
