The City of Ocala Public Work Department is seeking bids from a qualified Contractor who will provide materials, labor, and equipment for the placement of roadway pavement striping and markings for Traffic Annual Striping services. This work includes but is not limited to, pavement edge lines, skip traffic stripes, solid traffic stripes, directional arrows, pavement messages, island nose reflective paint, reflective pavement markers, and flexible breakaway delineator posts. Note: Minor scraping of ROW may be required to install/replace pavement edge lines properly. CONTRACT TERM 1. The resulting contract will be for two (2) years. Renewals: Optional two (2) one-year (1-year) renewals. The resulting contract will begin on November 1, 2024. o Renewal Pricing Increases. Pricing shall remain firm and fixed during the Initial Term of this Agreement. Any renewal price adjustment shall be subject to negotiation and must be approved by the City of Ocala. Vendor shall submit a written request for price adjustment identifying the reason for the price increase, and attach suitable documentation in support of same, no less than NINETY (90) DAYS before the expiration of the then existing Contract Term. No retroactive price adjustments will be allowed. Pricing increases shall not exceed the lesser of (i) the amount of the percentage increase reflected in the Consumer Price Index for all Urban Consumers (CPI-U), not seasonally adjusted, based upon the most recent TWELVE (12) MONTH period; or (ii) THREE PERCENT (3%) ANNUALLY unless there are mitigating market conditions. Insurance requirements : Commercial General Liability: Vendor shall procure, maintain, and keep in full force, effect, and good standing for the life of the contract a policy of Commercial General Liability insurance with limits not less than (a) One Million Dollars ($1,000,000) per occurrence and Two Million Dollars ($2,000,000) aggregate (or project aggregate, if a construction project) for bodily injury, property damage, and personal and advertising injury; and (b) One Million Dollars ($1,000,000) per occurrence and Two Million Dollars ($2,000,000) aggregate (or project aggregate, if a construction project) for products and completed operations. (c) Policy must include coverage for contractual liability and independent contractors. (d) Policy must include Additional Insured coverage in favor of the City. Liquidated Damage : For individual projects, the Contractor shall pay the City using the schedule below for each calendar day that expires after the time specified for Substantial Completion until the Work is substantially completed. After Substantial Completion, if the Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Times or any proper extension thereof granted by the City, the Contractor shall pay an additional $200.00 per day for each calendar day that expires after the time specified. Amount of Liquidated Damages: Applicable liquidated damages are the amounts established in the following schedule: $50,000 and under $763 Over $50,000 but less than $250,000..$958 The liquidated damages set forth herein shall not be accumulative. If Substantial Completion of the Work is not met within the time specified for completion of all Work, the liquidated damages shall continue to be at the rate or rates specified for default on Substantial Completion until Substantial Completion is attained. If the Work is not then finally completed, the rate or rates specified for default on completion shall apply until completion is attained. The City shall have the right to deduct the liquidated damages from any money in its hands, otherwise due, or to become due, to the Contractor, or to initiate an applicable dispute resolution procedures and to recover liquidated damages for non-performance of this contract within the time stipulated. Maintenance and Guarantee Bond: The successful bidder will also be required to furnish a Maintenance and Guarantee Bond for 10% of the total project value, before final payment for one (1) year for labor and one (1) year for materials from the date of completion. The Contractor shall always provide supervision of all work crews while performing work under this contract. Each work crew shall have a designated person on the work site who has the authority to respond to inquiries about work details or priorities.
