Water Treatment Plant Elevated Water Tank The corrected deadline for questions is August 28, 2024 by 2:00 p.m. Please disregard the date of July 24, 2024 published on the legal notice. Questions should be directed to Scott Belcher with the Water Treatment Plant at scottbe@cityofmiddletown.org by 2:00 p.m. on Monday, July 24, 2024. All proposals shall be made and properly executed on proposal forms as issued by the City and bound together with other documents and specifications. All proposals containing bids not asked for orwhich are otherwise not in conformity with this notice will be considered informal and may be rejected. Each bidderis required to state in his proposal his name and place of residence and the names of all persons interested with him. In the case of a corporation, only the names of the President and Secretary will be given. No bid will be allowed to be withdrawn after it has been deposited with Public Work & Utilities. Bids shall be accompanied by a bid guaranty bond, a certified check, cashier's check, or letter of credit in the amount of 10% of the bid. The successful bidder will be required to execute the contract and to provide a 100% performance bond within ten (10) days after the award of the contract. In case the bidder neglects to so execute the contract, the check accompanying the proposal shall be forfeited to the City of Middletown, not as a penalty, but as liquidated damages. The address and telephone number of the bonding company and agent must be included with all bid guaranty bonds and performance bonds. Bidders must comply with the Federal Prevailing Wage Rates on Public Improvements in Butler County and the City of Middletown, Ohio as determined by the U. S. Department of Labor under the Davis - Bacon and related Acts, Wage and Hour Division. This procurement is subject to the EPA policy of encouraging the participation of small businesses in rural areas (SBRAs). Contractors must certify that they have met the requirements of the Ohio Bureau of Worker's Compensation's (BWC) Drug Free Workplace Program to be eligible for state/federal funded construction projects including grants within ten days of the bid award. The bid will be deemed non-responsive and not eligible for the award of contracts if this certification is not met. The right to reject any or all bids is reserved by the City of Middletown. Informalities may be waived at the option of the City Council. The project is fully or partially funded through the Ohio State Revolving Fund Program with federal funds from the U.S. Environmental Protection Agency. General contractors and all subcontractors must meet DWSRF / WSRLA requirements and provisions. This procurement is subject to the EPA policy of encouraging the participation of small business in rural areas (SBRAs).
