The City will start counting Calendar Days on the date that the Notice to Proceed is issued. It is understood and agreed that time is of the essence and that should the Contractor fail to complete the Contract within the time specified or within any proper extension thereof granted by the City, the Contractor shall pay liquidated damages in the amount of $500.00 per Calendar Day for each Calendar Day that elapses after the allowed construction time expires, until the project is deemed complete by the City. Little demolition work is expected as part of the project, but what is required shall be considered subsidiary to the stated bid items. Excess soil or other materials that are generated by the project may be disposed of on site if allowed by the property owner. The Contractor is responsible to properly dispose of items or materials that are not allowed to be wasted on site. This will also be considered subsidiary to the stated bid items.
