The contractor shall upload a copy of his bidder's bond in the amount of five percent (5%) of the amount of the bid as required by Section 48-01.2, North Dakota Century Code, as amended, and executed as provided by law, The bid bond shall be conditioned that if the principal's bid is accepted and a contract is awarded, the principal shall execute the contract within ten days of receipt of the notice of award. The basis of award shall be the lowest and best bid for the City. Bids shall be made on the basis of cash payment for the work to be done. All work under this advertisement shall be started on a date to be specified in a written order from the City Commission. The City Commission reserves the right to hold all bids for a period of thirty (30) days after the date fixed for the opening, reject any or all bids, and to waive irregularities whenever it is for the best interest of the City. Work shall consist of approximately 4,800 tons of blended base, 10,500 LF curb and gutter, 7,300 tons AC Superpave, 26,000 SY of seal coat, and related items.
