Renovation of a museum in Lennox, South Dakota. Completed plans call for the renovation of a museum.
Each bid must contain a Certified Check, a Cashier's Check or Draft for five percent (5%) of the amount of the total bid items, such Check or Draft to be certified or issued by either a State or National Bank, and payable to the City of Lennox, or in lieu thereof, a Bid Bond for ten percent (10%) of the amount of the bid, such Bid Bond to be issued by a surety authorized to do business in the state and payable to the City of Lennox. Said Certified Check, Draft or Bid Bond guarantees the execution of a contract and shall be held by the City of Lennox until said contract is executed. SDCL5-18A. All bids and contracts shall be made in accordance with, and subject to SDCL 5-18A, 5-21, 5-22 and the provisions set forth in the specifications. The Lennox City Council reserves the right to reject any and all bids or parts thereof, and to waive any irregularities. By virtue of statutory authority, preference will be given to labor, materials, products and supplies found or produced within the State of South Dakota A resident bidder is allowed a preference as against the bid of any bidder from any other state enforcing or having a preference for resident bidders, equal to such preference. The successful bidder shall be required to provide a contract performance bond and a payment bond in the penal amount of one hundred percent (100%) of the contract price in a form approved by the City, dated and executed the same date as the contract documents to comply with statutory requirements, in accordance with SDCL 5-21.Proposals shall be addressed, sealed and delivered to the City of Lennox or a representative at Lennox, South Dakota, at the place, date and time hereinbefore stated. Proposals submitted after the time and date stated above shall be returned unopened. Any proposals submitted by mail must be received prior to the time fixed for opening. Any proposals in the mail prior to the time set, but not received prior to such time shall be returned unopened. All bids shall include any addenda issued during the time of figuring the same as although it had been included in the original Drawings and Project Manual. Time is an essential element of the contract. It is important that the work be pressed vigorously to completion. The cost to the School District of the administration of the Contract, including architectural, engineering, inspection, and supervision, will be increased as the time occupied in the work is lengthened. Should the Contractor fail to substantially complete the work within the time set forth herein or within such extra time as may have been allowed by increases in the contract time or by formally approved extensions granted by the Owner, the Contractor and the Contractors surety shall be liable for and shall pay the Owner $500.00 per calendar day as liquidated damages for each calendar day of delay until the work is substantially complete. Permitting the Contractor to continue and complete the work covered by the terms of the contract after the expiration of the working time provided for therein and inclusive of any extensions granted, shall in no way be construed as a waiver by the Owner of its rights under the contract. Work shall be commenced within TEN (10) days after written NOTICE TO PROCEED and shall be completed on or before: PHASE 1 (ROOFING) - THURSDAY, OCTOBER 31, 2024 PHASE 2 (WINDOWS) - MONDAY, DECEMBER 2, 2024
