Santa Rosa County Board of County Commissioners will receive sealed bids for Asphalt Services. Asphalt Construction Services will include asphalt paving, asphalt resurfacing, road grading and construction, asphalt milling, asphalt patching, asphalt leveling, bituminous crack relief layer, pavement marking, and the providing of asphalt materials to include being picked up by county trucks at the asphalt plant. Contractor shall have FDOT certification for paving projects with Superpave asphaltic concrete. It is the intent of the County to enter into a One (1) year contract. All prices are firm for a period of one year. After one year, for each subsequent year, the County may approve the option of renewing the contract at the same or a lesser price for a (1) year period, not to exceed two (2) years, upon the agreement of both parties. Upon renewal, the County may in its sole discretion, make an equitable adjustment in the Contract terms and/or pricing if pricing or availability of supply is affected by extreme and unforeseen volatility in the marketplace, that is, by circumstances that satisfy all the following criteria: (1) the volatility is due to causes wholly beyond the Contractors control, (2) the volatility affects the marketplace or industry, not just the particular Contract source of supply, (3) the effect on pricing or availability of supply is substantial, and (4) the volatility so affects the Contractor that continued performance of the Contract would result in a substantial loss. The Contractor shall provide thirty (30) days written notice to the County and written approval from the County is required. Documentation of cost adjustments shall be provided by the Contractor to the County and may include but not be limited to published and cost indexes.
