The City of Salina, Kansas, reserves the right to reject any or all proposals and to waive any irregularities therein. The drawings, specifications and other contract documents are the property of the City of Salina, Kansas, and are available for public inspection at the office of the Director of Parks and Recreation, City-County Building 300 West Ash, Room 100, Salina, Kansas and at Kaw Valley Engineering, Inc. 1627 Sunflower Lane, Salina KS 67401. Questions regarding these Instructions to Bidders or the other Contract Documents shall be submitted in writing to the project contact no later than seven (7) days prior to the opening of Bids. The project contact shall respond in writing, via facsimile, to all plan holders in an expeditious manner, and no later than three (3) days prior to the opening of Bids. Each Bidder shall submit with its Bid a certified check, cashier's check on a solvent bank, or an acceptable bidding bond, in the amount of five percent (5%) of the total bid amount shown on the Bid. This security shall be made payable to the City and will serve as a guarantee that the Bidder will file all bonds and securities required and enter into any Contract awarded to Bidder in accordance with the terms of the Bid within ten (10) days after notice of award. If the successful Bidder fails to execute and deliver the Contract and furnish the required bonds within ten (10) days after the notice of award, the City may consider the Bidder to be in default, annul the notice of award, and the bid security of that Bidder shall be forfeited as liquidated damages and the money derived therefrom will be turned to the use of the City. Statutory and performance bonds are required for all contracts of $50,000 or more. Bid bonds are required for all bids. (a) PERFORMANCE BOND. A performance bond, in the form provided by the City, running to the City, conditioned upon the prompt, full, and complete performance by the Contractor as principal of all covenants, obligations, and agreements contained in the Contract Documents. The performance bond shall remain in effect until completion of the two (2) year warranty period specified in Section 46 below. (b) STATUTORY BOND. A payment bond, in the form provided by the City, running to the State, conditioned that the Contractor as principal shall pay all indebtedness incurred for labor, supplies, equipment, and materials furnished in making the improvements called for by the Contract Documents.
