All bid proposals shall be accompanied by a bid deposit by means of a cashiers check, certified check, or Bid Bond in an amount equal to not less than five percent (5%) of the base bid amount, as shown on the Bid Form. Should the successful bidder fail to enter into a contract and furnish satisfactory Performance Bond within the time stated in the specifications, the bid deposit or bond shall be forfeited to the City of Yelm. The Work to be performed under this contract includes providing labor, materials, and equipment necessary for grading, earthwork, excavation, underground utility work, paving, seal coating, striping, pavement repairs, demo and removal of existing pavement, and other related miscellaneous work as requested by the City of Yelm Engineer. It is the Citys intent to establish an "on-call" contract for these services for a three (3) year period, with an option for a single, one (1)-year extension, or when the total cost of work (including Washington State sales tax) performed under this contract reaches, but does not exceed $750,000, whichever occurs first The Work is on an on-call basis with the start and completion dates to be mutually determined by the City Project Manager and the Contractor at the time Work is requested. Contractor agrees to mobilize and be available to perform Work within five (5) business days of each request, unless otherwise agreed. The City of Yelm reserves the right to reject any and all bids, waive any informalities or minor irregularities in the bidding, and determine which bid or bidder meets the criteria set forth in the bid documents.
