The project consists of selecting and ordering a permanent generator to be installed at the District's water treatment plant located near the intersection of 3rd Street and Lewis Street in Christoval, Texas. The new, permanently installed generator will be on a concrete pad. Electrical demolition of old wiring components, along with new electrical work to connect the generator to the plant is detailed in the plans. Each bid must be accompanied by cash or a certified cashier's check, drawn on a bank or trust company authorized to do business in the State of Texas, payable to Tom Green County FWSD #2 in an amount at least equal to five percent (5%) of the total amount of the bid, as a guarantee that a contract will be entered into. In lieu of cash or a certified check, the Bidder may submit a bid bond in the form prescribed in paragraphs 5.01 and 5.02 of the General Conditions. This contract is subject to the Environmental Protection Agency's (EPA) Disadvantaged Business Enterprise (DBE) Program, which includes EPA-approved fair share goals toward procurement of Minority and Women-owned Business Enterprise (M/WBE) businesses. EPA rules require that applicants and prime contractors make a good faith effort to award a fair share of contracts, subcontracts, and procurements to M/WBEs through demonstration of the six affirmative steps. Each contractor awarded a construction contract must furnish performance and payment bonds: The performance bond shall include without limitation guarantees that work done under the contract will be completed and performed according to approved plans and specifications and in accordance with sound construction principles and practices; The performance and payment bonds shall be in a penal sum of not less than 100 percent of the contract price and remain in effect for one year beyond the date of approval by the Engineer of the political subdivision; and The contractor shall utilize a surety company which is authorized to do business in Texas in accordance with Surety Bonds and Related Instruments, Chapter 3503 of the Insurance Code. The right is reserved to reject any or all bids, to waive informalities, and to award contract or contracts which, in the opinion of the Tom Green County FWSD #2, appear to be in its best interest. Tom Green County FWSD #2 reserves the right to hold any or all proposals for the period of time from the opening of bids as specified in Section 00300, Bid Form.
