Site work and new construction of a pre-engineered storage facility in Sayreville, New Jersey. Completed plans call for the construction of a pre-engineered storage facility; and for site work for a pre-engineered storage facility.

This Request for Bids ("RFB") involves all necessary labor, tools, equipment, material, and services required to complete all work as specified on the Contract Documents. Further information concerning this procurement is provided in the RFB for such services. No Bid will be accepted after the above referenced date and time. Any Bid received after the due date, whether by mail or otherwise, will be returned unopened. Each Bidder must submit with its Bid, Bid Security in the form of a Bid Bond executed by the Principal and Surety Company Attorney in Fact and witnessed to and attested with an appropriate Power of Attorney attached, or a cashier's check, or treasurer's check or certified check or money order made payable to the order of the Treasurer, Middlesex County Utilities Authority and in the amount of five percent (5%) of the Bid price. In addition to the Bid Security, each Bid must be accompanied by a Consent of Surety written by a Surety Company listed on the Federal Treasury List and is licensed to do business in New Jersey and acceptable to the Authority, that in the event of an award of the Contract to the Bidder, said Surety will furnish the required contract bond(s) in the sum of the full amount of the Bid as set forth and as required in the RFB. The contract bond(s) for this RFB include the following and must be from a surety company acceptable to the Authority and satisfying the requirements of the RFB: - Performance and Payment Bond - General Maintenance Bond The Successful Bidder will be required to present to the Authority the approved contract bonds duly executed and be prepared to execute the Contract within twenty-one (21) days of the date of receipt of the Notice of Contract Award. All Bidders and named Subcontractors must possess current and effective Public Works Contractor Registration Certificates ("PWCR") as of the Bid opening date. A Bidder who does not possess a valid PWCR as of the Bid opening date, or who names any Subcontractor in its Bid who does not possess a valid PWCR as of the Bid opening date, will be deemed ineligible for Contract award. Bidders may submit copies of all applicable PWCR certificates with their Bids. However, if copies of any of these certificates are omitted from the Bid, they shall be provided to the Authority prior to award, and within five (5) business days of its request. The Authority shall have the right to independently verify Bidders' and named Subcontractors' PWCR status from computerized systems maintained by the State and shall be guided accordingly in its award process. Should the Successful Bidder fail or refuse to execute the Contract and/or submit any other required documents within the time period set forth in this RFB, the Authority shall have the right to consider the Successful Bidder to have abandoned the Contract and the Authority may proceed to award the Contract to the next lowest responsive and responsible Bidder or if applicable, reject bids pursuant to N.J.S.A. 40A:11-13.2. Bids must be submitted in sealed envelopes with the name "MCUA: CONTRACT 22-9-1(CTP)/ CONSTRUCTION OF A CENTRALIZED STORAGE FACILITY AT THE CENTRAL TREATMENT PLANT" clearly marked on the outside of the envelope. Bids may not be e-mailed, faxed or transmitted over the telephone. This project is being funded partially through Federal Grants awarded by the State of New Jersey. The Federal Grant funding is through the Coronavirus State Fiscal Recovery Fund under the American Rescue Plan Act of 2021, P.L. 117-2, as amended. Consequently, this RFB and the Contract involved includes and incorporates the contract requirements under Federal funding procurement awards in accordance with 2 CFR Part 200 Appendix II. The Bidding and award of the Contract will be in compliance with the New Jersey Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.). By submitting a Bid, each Bidder, without any other act, acknowledges and agrees to comply with each of the terms and conditions of the RFB. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq. As a result of the partial Federal funding involved with the Project, Bidders and their subcontractors must also be able to provide a Unique Entity ID ("UEI") from Sam.Gov (the System of Award Management) and must maintain an active SAM registration through Final Completion of the Project. Please consult online for more information or if you have questions about obtaining an UEI. The Authority will award a contract or reject all Bids within sixty (60) days after receipt of the Bids unless otherwise agreed by the parties in accordance with applicable law. Any inconsistency between this notice and the RFB shall be governed by the terms of the RFB. The Authority reserves the right to waive any minor immaterial informalities or reject all Bids in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., as well as any other applicable law. Bidders are expected to examine the RFB and all related Bid documents with care and observe all their requirements. Ambiguities, errors, or omissions noted by Bidders together with all questions and requests for clarifications pertaining to this RFB shall be submitted via e-mail to 4878-6273-6084, v. 4 6 the attention of Judith McCrone, Procurement Specialist, at jmccrone@mcua.com or in writing to the Authority, by no later than 4:00 p.m. on October 11, 2024 at the Middlesex County Utilities Authority, 2571 Main Street Extension, Sayreville, New Jersey 08872. Attn: Judith McCrone. Notice of revisions or Addenda to advertisements or Bid documents will be noticed as outlined in N.J.S.A. 40A:11-23(c). The owner will transmit a notice of revisions or Addenda to advertisements or Bid documents no less than seven (7) working days prior to Bid opening as found in N.J.S.A. 40A:11-23(c).
