1. This contract shall call for the Contractor to supply labor and equipment to remove snow and/or ice from certain designated public sidewalks, the Fire Hall driveway, and occasionally the parking lot at the Court House, in the Town of Shaunavon. 2. The basis of payment shall by the hour and shall be paid once per month. The Contractor shall invoice the Town of Shaunavon accordingly. 3. The snow/ice in most locations shall be removed and placed in the gutter or boulevard. For certain locations such as at the Court House the snow/ice from Third Street West cannot be placed out onto the street; it shall be put onto the grass. 4. The Contractor shall at all times ensure the safety of the public when carrying out snow removal duties. The Contractor shall have a safety policy, or they shall adhere to all safety policies adopted by the Town of Shaunavon. 5. The Contractor shall have Saskatchewan Workers Compensation at all times. 6. Payment will be based on the quoted rate. The contractor shall submit a detailed breakdown of services provided. 7. The contract to start as required once the agreement is in place. 8. The price shall include all costs to complete the job. No other allowances will be made in the contract. 9. No work shall be undertaken unless authorized by the Chief Administrative Officer or Director of Public Works or the Director of Parks Recreation and Facilities of the Town of Shaunavon. A mutually agreeable protocol will be determined. 10. This contract for services does not include a guaranteed minimum of work. The amount of work to be performed is totally at the discretion and direction of the Town of Shaunavon. 11. Contractor will need to provide service in a timely fashion. Priority to be given to the fire hall, Grand Coteau Heritage and Cultural Centre, and Court House sidewalks, but all areas are important and need to be done in a safe and timely manner. 12. Equipment being operated must follow all traffic and safety regulations. 13. The contract may be extended if agreed to by both parties. 1. Insurance: a. The Contractor shall provide and maintain comprehensive General Liability Insurance and provide and maintain liability insurance in respect of owned licensed motor vehicles. The Contractor shall list the Town of Shaunavon on the contractor's insurance as a Loss Payable. Minimum amount - $5,000,000.00. b. Each insurance policy shall name the Town of Shaunavon as additional insured as their interest may appear and such policies will contain where appropriate: i. a waiver of any subrogation rights which the Contractor's insurers may have against the Town of Shaunavon, its councillors, directors, officers, employees, contractors, agents and representatives; ii. a severability of interests clause or a cross-liability clause; iii. a clause stating that the Contractor's insurance policy will be considered as the primary insurance and shall not call into contribution any other insurance that may be available to the Town of Shaunavon. 2. The Contractor shall take all necessary precautions whenever working to protect the public and property. 3. The Contractor shall be responsible for obtaining and paying for all permits and/or licenses as may be required, and comply with all municipal, provincial and federal regulations. 4. The Contractor shall be responsible for any and all damage to private property/vehicles. 5. The Contractor shall be responsible to ensure minimal damage to grass on either side of sidewalks and is responsible for all sprinkler heads located along these sidewalks. Specifically this refers to the Shaunavon Town Office (Courthouse) and Museum. 6. Each party must give 30 days written notice of termination of the Contract. 7. It is the responsibility of the successful bidder to supply all manpower, vehicles and equipment.
