Oak Knoll Drive, Corcoran Place, Baywood Lane Paving Improvements. Each individual proposal shall be accompanied by a Bid Bond made payable to the City of North College Hill in a sum equivalent to 100 percent (100%) of the bid amount. The successful bidder, upon receipt of acceptance of their proposal, must furnish 100% Performance Bond and 100% Labor and Material Payment Bond to the Owner. All bidders must comply with the prevailing wage rates on Public Improvements in Hamilton County and the City of North College Hill as determined by the Ohio Department of Commerce, Bureau of Wage & Hour Administration. The City of North College Hill, at its discretion, reserves the right to waive any and all informalities in the bidding. The drawings depict all underground utility facilities known to exist from diligent field checks and from information provided by utility companies. The Engineer does not guarantee that all existing utility facilities are shown on the drawings and does not assume any liability for the location of utilities including individual service lines. Utilities not underground, individual utility services outside of public right-of-way, private systems for single or double family dwellings utilized for only that dwelling and not connected to any other system, are not included on the plans. Questions received less than seven (7) days prior to bid date cannot be answered. Any addenda issued during the bidding period are to be included in the Proposal and shall become a part thereof. All the work under this Contract shall be done in accordance with the Plans and Specifications. The Engineer will determine the amount, quality, acceptability and fitness of the several kinds of work and materials which are to be paid for hereunder and will decide all questions of fact, but not of law, which may arise as to the fulfillment of the contract on the part of the Contractor. The Engineer's determination and decision thereon shall be final and conclusive and such determination and decision, in case any questions of fact arise, shall be a condition precedent to the right of the Contractor to receive any monies hereunder.
