The deadline to submit questions related to this project is Thursday, November 21, 2024. Questions must be received may submit a request for an interpretation or correction thereof to the Project Engineer, Anna Caffrey, P.E., Bohannan Huston, Inc., at online. The Middle Rio Grande Conservancy District (MRGCD) is soliciting bids from qualified companies for the Belen Highline Canal Overflow Structure 1 project, in accordance with the outlined scope of work contained in the bidding forms and Contract Documents. Bid responses not received by the due date and time will not be accepted, no exceptions. The new mexico procurement code, sections 13-1-28 through 13-1-199 nmsa 1978 imposes civil and criminal penalties for its violation. In addition, the New mexico criminal statutes impose felony penalties for illegal bribes, gratuities and kick-backs. The Project includes the construction of Overflow Structure 1 on the Belen Highline Canal, consisting of approximately 3,700 SY of shotcrete lining for the canal and the creation of a stepped overflow structure to the farm east of the canal. The project includes associated earthwork, concrete walls, and maintenance ramps. The project includes associated earthwork, concrete walls, and maintenance ramps and grading. The MRGCD is the contracting agency. The intent of this contract is to perform the identified work under the schedule set forth in these contract documents, as well as to establish bid items and corresponding unit prices. The duration of this contract is One Hundred Five (105) calendar days for substantial completion and One Hundred Thirty Five (135) calendar days for final completion from the Notice to Proceed for Construction for the Belen Highline Canal Overflow Structure 1 Project. All applications, contract administration, pay estimates, and change orders will be processed by MRGCD. BIDDER QUALIFICATION: A. Contractor's License: Bidders must have a New Mexico contractor's license, in one of the following classifications: GF-3, GF-4, or GF-98 as determined by New Mexico Construction Industries Division. B. Bidder's Preference: A ruling by the New Mexico Attorney General's Office states that the Resident Bidders Preference, set forth in Section 13-1-21, NMSA, 1978, Comp., as amended, (Public Purchases Act), must be applied to all bids awarded for work performed on all public works projects. Any questions concerning the above New Mexico Statute should be referred to legal counsel. It shall be the sole responsibility of the bidders requesting consideration for Resident Bidder, Native American Resident Bidder, Resident Veteran Bidder, or Native American Resident Veteran Bidder's Preference to apply to the New Mexico State Purchasing Director for certification, and to receive approval and a certification number, which must be included on the Bid Proposal prior to bid opening deadline date and time. The additional preference percentage will be applied to the total bid amount for either Resident Bidder, Native American Resident Bidder, Resident Veteran Bidder, or Native American Resident Veteran Bidder (no accumulation of preference percentage). Requests for qualification for Resident Bidder, Native American Resident Bidder, Resident Veteran Bidder, or Native American Resident Veteran Bidder's Preference certification after bid submission deadline date and time will not be considered. BID SECURITY: Each proposal must be accompanied by a Certified Check or a Bid Bond acceptable to MRGCD in an amount which shall be not less than five (5) percent of the amount of the bid, payable without condition to MRGCD as a guarantee that the bidder, if awarded the Contract, will within seven (7) days, execute such Contract in accordance with the proposal and in the manner and form required by the Contract Documents and will furnish good and sufficient bond for the faithful performance of the same, and for payment for all labor and material. The bid security of the three lowest bidders will be retained until the Contract is executed or other disposition is made thereof. The bid security of all bidders except the three lowest will be returned promptly after the canvass of bids. Bid security in the form of bonds will not be returned unless requested. LOCATION: MRGCD, rights-of-way and/or easements located as detailed on the Construction Drawings, for the Belen Highline Canal Overflow Structure 1 Project, in Belen, NM.
