Reference Number 0000282452 Question Acceptance Deadline 2024/12/05 12:00:00 PM CST Pricing Lump sum Seal Coat Class A The aggregate for Seal Coat Cover, Class A shall be in accordance with the Specifications for Aggregate for Seal Coat Cover. Stockpiling Notwithstanding Specification No. 600.4, the base for stockpiles will be measured in cubic meters. When the unit of measure is cubic meters, the Department shall survey the original ground prior to commencing stockpiling operations. If the contractor commences stockpiling prior to the Department's survey measurements of the base for the stockpile, the contractor will level all material placed at the stockpile location. The Department will then measure the base. No payment will be made for material which has been leveled or any costs associated with leveling such material. Acceptance Testing When material is identified to be paid by EPP, the results of the Department's Acceptance testing will form the basis for acceptance of material. The Contractor shall inform The Department when they are ready for acceptance testing. Sample shall only be taken from the designated stockpiles once produced. The Department will conduct ten (10) tests for each stockpile of aggregate. Each sample will be split into three (3) samples of approximately equal weight. One sample will be given to the Contractor, one will be tested by the Department, and the third will be retained by the Department for potential appeal testing. Testing of the acceptance samples will be conducted by one of the Department's Central laboratories and the results shall be binding. Acceptance samples may be randomly collected at any time, at the Departments discretion, either during production or after material has been stockpiled. Acceptance samples may be taken directly from the crusher or from the existing stockpile after it has been produced. Acceptance samples taken directly from the crusher the contractor shall not make piles with more than 5,000 m3. The Department will take 10 samples for every 5,000m3 pile produced only then will the contractor be able to deliver this material to the stockpile site. Contractor shall be responsible for collecting samples at the stockpile location for acceptance testing, they shall be collected following MEB-P047. The contractor shall conduct acceptance sampling in the presence of an MI representative and shall relinquish samples for acceptance and potential appeal testing to the MI representative. A representative from the Contractor shall be present for the acceptance test sampling of each stockpile, unless the Contractor informs the Engineer that he will not be attending. Gradation, crush count, and shale will be included in the acceptance or rejection of all EPP samples. Completion Model The Contract will be assessed Liquidated Damages in accordance with the Specification for Liquidated Damages Completion Specified by Completion Date. Liquidated Damages All work shall be completed free of daily liquidated damages on or before MARCH 21, 2025. Daily Liquidated Damages after this specified Completion Date will be charged to the Contractor at the rate of FIVE HUNDRED ($500.00) Dollars per calendar day until the Work is completed. Non performance The normal penalty for non-performance will be removal from the bidders list for two (2) years. Reinstatement after two (2) years will be on approval of the Department.
