If the highest amountbid exceeds $250,000, the bidsecurity shall be in an amount ofnot less than five percent (5%)of the highest amount bid by either (a) a certified or cashier'scheck made payable to Jefferson County Drainage DistrictNo. 7, Port Arthur, Texas, drawnon a Texas bank or (b) a bidbond issued by a surety authorized to do business under thelaws of the state of Texas. Thebid security serves as a guaranty that if awarded the contract,the bidder will enter into a contract and execute bonds on theforms provided within ten (10)days after notice of award ofcontract. Checks of the unsuccessful bidders will be returnedwhen the award is made; that ofthe successful bidder will be returned when the formal contractand bonds are approved. The successful bidder must furnish performance and paymentbonds on the form furnishedfrom a surety company holding a permit from the State ofTexas to act as surety.
