In general, the work shall consist of furnishing all labor, materials, equipment, and incidentals for construction of the following work: Approximately 6,057 linear feet of 90-inch to 120-inch combined sewer overflow storage tunnel, four access shafts (one of these excavated by others), one screening structure, one diversion/gate/screening structure, one gate control vault, 1,000 feet of 36-inch to 72-inch trenchless and 680 feet of 24-inch to 90-inch open-cut consolidation and relief sewers, 127 feet of 5-foot x 7-foot double barrel box culvert overflow sewer, eight new regulators, sewer rehabilitation, regulator improvements, and other sewer improvements. The project is located in Cleveland, Ohio with elements at various sites between East 40th Street and East 149th Street, generally near the Opportunity Corridor highway and Kinsman Road. The NEORSD reserves the right to reject any and all Bids, and to waive any informalities or irregularities in the Bids received. Bidders shall review the Instructions to Bidders and all other contract documents prior to submitting a bid for this project. The successful Bidder also must comply with all the provisions of (a) The Davis-Bacon Act, (b) Contract Work Hours Standard Act, (c) The Copeland Act (Anti-Kickback), (d) Title VI of the Civil Rights Act of 1964, (e) the Byrd Anti-Lobbying Certification, (f) Build America, Buy America, (g) American Iron and Steel provisions Section 436 of P.L. 113-76, Consolidated Appropriations Act and all other applicable provisions as specified in the Contract Documents. The Contract will be subject to the NEORSD policies and goals regarding the use of minority, women, and small business enterprises (MBE/WBE/SBE) and the USEPA Disadvantaged Business Enterprise (DBE (MBE/WBE)) Utilization Program. These policies are contained in the Contract Specifications. Individual program goals for this Contract are as follows: NEORSD Business Opportunity Program: 10% MBE/WBE and 5% SBE USEPA DBE Utilization Program: 1.3% MBE and 1.0% WBE The Estimate of Probable Construction Cost for the Kingsbury Run Consolidation Sewer Project is $105,000,000. ORC Section 153.12 states that a public improvement contract may not be entered into if the price of the contract is in excess of twenty percent (20%) above the project estimate. Pursuant to NEORSD Bylaws and policy, the NEORSD may establish a percentage less than 20 percent (20%) for any public improvement project. For this Project, the price of the contract may not be in excess of ten percent (10%) above the Estimate of Probable Construction Cost.
