The Johnson County PWSD No. 3 reserves the right to award the contract to the "lowest and best responsible bidder". The District further reserves the right to waive any irregularities in any or all bids, reserves the right to determine which is the most responsive, responsible bidder, and to reject or approve the bids. Each bid must be accompanied by a bid security of 5% of the total amount of the bid (bid bond, cashier's check, or approved money order payable to the Johnson County PWSD No. 3). Work under this contract to be fully complete within 180 calendar days upon Notice to Proceed. LIQUIDATED DAMAGES The bidder agrees to pay liquidated damages, the sum of $500.00 for each consecutive calendar day after the Contract Time as provided in Section 15 of the General Conditions. The project is financed in part by the Coronavirus State and Local Fiscal Recovery Funds (SLFRF) program through the American Rescue Plan Act (ARPA). The Johnson County PWSD No. 3 is an Equal Opportunity Employer. The wage rates applicable for this project have been predetermined as required by the State of Missouri Prevailing Wage Law and are set forth in the proposal. The Contractor shall comply with all requirements regarding immigration and e- verification of citizenship. The Contractor shall also comply with all requirements regarding OSHA safety training. Bonding, insurance, and other requirements and certifications are set forth in the bid documents. Question Deadline 01/02/2025 BID AND PERFORMANCE GUARANTY Each Bid must be accompanied by a Bid Bond, Cashier's Check, or approved Money Order payable to the Owner for 5 percent of the total amount of the Bid. As soon as the bid prices have been compared, the Owner will return the bond, check, or money order of all except the three lowest responsible Bidders. When the Agreement is executed the bonds of the two remaining unsuccessful Bidders will be returned. The Bid Bond of the successful bidder will be retained until the payment bond and the performance bond have been executed and approved, after which it will be returned. A certified check may be used in lieu of a bid bond. The Owner may waive any informalities or minor defects or reject any and all Bids. Any Bid may be withdrawn prior to the above scheduled time for the opening of Bids or authorized postponement thereof. Any Bid received after the time and date specified shall not be considered, will not be opened, and will be returned to the Bidder. No Bidder may withdraw a Bid within 90 days after the actual date of the opening thereof. Should there be reasons why the contract cannot be awarded within the specified period the time may be extended by mutual agreement between the Owner and the bidder.
