Davis Point Quarry Stockpile site NW 26-31-10 WPM 4. Hartman Construction Stockpile site SE 29-27-7 WPM 5. Mulvihill Stockpile site NW 6-23-5 WPM 6. Hartman Construction Stockpile NE 24-31-10 WPM 7. Moosehorn (Nichol Pit) NW 31-26-6 WPM The term of this agreement shall be from the date of this Agreement to July 15, 2025 unless soon terminated by either party in accordance with the terms stated herein; The Contractor shall be registered with and be in good standing with the Worker’s Compensation Board and supply proof of Workers Compensation and Liability Insurance coverage – Three Million Dollars minimum; This Agreement will consist of loading, hauling and depositing Gravel/Crushed Rock from Graymont Western Canada Inc. and other designated stockpile sites onto Municipal Roads as directed by the Municipality’s Public Works Manager. Material for this agreement will be obtained from the following locations: Graymont Western Canada Inc. – Faulkner Moosehorn Stockpile site - NE 30-26-6 WPM Davis Point Quarry Stockpile site - NW 26-31-10 WPM Hartman Construction Stockpile site - SE 29-27-7 WPM Mulvihill Stockpile site - NW 6-23-5 WPM Hartman Construction Stockpile NE 24-31-10 WPM Moosehorn (Nichol Pit) NW 31-26-6 WPM Proposals not conforming to the proposal form may be disqualified. Awarding of the Agreement may be subject to inspection of the equipment. Council may reject proposals, waive defects or accept any proposal which they may consider in the best interests of the Municipality. The Municipality, at its sole discretion shall determine the quality of material to be used; The Contractor shall ensure that equipment is operated in accordance with applicable laws and regulations under the Manitoba Highway Traffic Act and shall be responsible for any damage caused by equipment owned and operated by the Contractor. The Municipality may delay or suspend the work if in its sole discretion road or weather conditions are unfavorable to continue. After the agreement is done, the Municipality will make payment based upon detailed time sheets submitted by the contractor and signed by Public Works Manager. Payment will be made at the following Council meeting after time sheets have been approved by Public Works Manager. The Municipality is responsible for all costs for gravel. Should this proposal be accepted by Council it will constitute an agreement between the R.M. and the contractor agreeing to complete the work on or before. If the work is not completed within the required time, liquidated damages will be charged in accordance with the applicable specifications, or as they may be amended by the Special Provisions, at the end of $1,000.00 dollars per working day. This agreement may be terminated by the R.M. of Grahamdale in its sole discretion if the contractor has failed to reasonably perform those obligations outlined in this agreement. The contractor shall restore any roads damaged during transportation of material for the tender to their original conditions and to the satisfaction of Council; Agreement is subject to a 5% holdback upon inspection of work completed. If any object is damaged or broken in the course of the Agreement, then the replacement and/or cost of the object is the sole responsibility of the contractor.
