The Scope of Work for the Project includes, but is not limited to, production, delivery, and placement of all new furniture for the Bowling Green ES Furniture Project. The work consists of furnishing fully assembled furniture to the District ("Work"). Vendor shall provide and pay for all furniture, labor, materials, equipment, tools, and other services necessary for the execution and completion of the Work in accordance with the Contract Documents and any applicable code or statute, whether or not specifically described herein, as long as same is reasonably inferable therefrom as being necessary to produce the intended results. Vendor shall, at its sole expense, obtain and maintain all permits and licenses required by any public authority in connection with performance of the Work. At its sole cost and expense, Vendor shall give all notices and comply with all laws, ordinances, rules, regulations, and lawful orders of any public authority bearing on the performance of its Work. Vendor shall conduct the Work so that all laws and ordinances for the protection of the public and the workers shall be obeyed fully. Vendor is responsible for initiating, maintaining and supervising all safety measures in connection with the Work, including while delivering furniture to the District's Site. Vendor shall pay all wages, fees, benefits, and other amounts due to personnel and subcontractors in connection with their performance of the Work and as required by law; pay all local, state, and federal taxes associated with its Work; and pay all amounts required by law in connection with employees including, but not limited to, Social Security taxes, income tax withholdings, unemployment insurance, and workers' compensation insurance premiums. Upon the District's request, Vendor shall furnish evidence satisfactory to the District that any or all of the foregoing obligations have been fulfilled. This Agreement is not intended to include any installation Work that requires a contractor's license and Vendor is not authorized to perform any such work hereunder. Vendor shall take all necessary precautions to protect the District's structures, equipment, furniture, and any other property on or adjacent to the Site against damage, loss, or theft resulting from the Work. Vendor shall repair or replace any damage and remove any damaged or defaced material and/or equipment from the Site at no cost to the District. Vendor shall be strictly liable for failure to adequately protect any existing improvements and/or facilities. Vendor will remove all dirt, debris, and waste from the Site generated in connection with its Work, and insure that the grounds are left clear and in the condition Vendor originally found them. The furniture is to be delivered to the following location: Bowling Green Elementary School, 4211 Turnbridge Dr, Sacramento, CA 95823 ("Site"). Delivery locations may not have loading docks. Vendor is required to make all necessary arrangements for lift trucks or other means necessary to complete delivery. Inside delivery to secured facilities may be required. Vendor acknowledges that the Work will be performed on a "tobacco-free" campus, and that possession of any tobacco product or e-cigarettes is prohibited on the District's property.
