Mailing costs will be $25.00 per set or contractor's account. No proposal shall be considered or accepted by the City Council or City Manager unless at the time of its filing the same shall be accompanied by a deposit with the City of Burlington of a certified check on some bank or trust company insured by the Federal Deposit Insurance Corporation, in an amount equal to not less than five per cent (5%) of the proposal. In lieu of making the deposit as above provided, such bidder may file a bid bond executed by a corporate surety licensed under the laws of North Carolina to execute such bonds; conditioned that the surety will upon demand forthwith make payment to the City of Burlington upon said bond if the bidder fails to execute the contract in accordance with the bid bond. The Bid Bond shall be for 5% of the bid. This deposit shall be retained if the successful bidder fails to execute the contract within ten days after award or fails to give satisfactory surety as required herein. A separate Performance Bond and Payment Bond each in an amount equal to one hundred per cent (100%) of the contract price will be required, using the enclosed forms. The City reserves the right to waive any informality or to reject any or all bids or to award such contract as in its judgment is deemed to the best interest of the City.
